“…Más allá de la conveniencia del control judicial al poder de reforma, es claro que tal revisión debe ser ejercida bajo un carácter prudente, uno que fomente que una Corte pueda convertirse en suprema no por imponerse sobre los demás poderes públicos y sobre la sociedad, sino por su deferencia democrática y por la promoción de las garantías de participación, deliberación y debido proceso democrático. Sin embargo, las Cortes se convierten en supremas generalmente por tener la capacidad de defender la Constitución y alternamente reescribirla (jurisprudencia constituyente), lo que podría convertir la revisión judicial de las enmiendas constitucionales en una justificación extensiva y sin límite para que el poder judicial se apropie de la Constitución y establezca su autoridad (Albert, 2019), desde luego en detrimento de la construcción colectiva del significado de la Constitución y de la legitimidad de las decisiones que se toman sobre ella, y en favor de una creciente dificultad contramayoritaria (Bickel, 1986;Jiménez, 2021).…”
