As a public official, a Notary has a role and obligation to ensure that what is in accordance with the wishes of the parties. A notary has the obligation to read the deed to the parties and write a statement of the circumstances of the appearer when he appears before the notary along with the reasons or statement of the deed not being read in the cover of the deed which is a provision contained in the law. If there is a misunderstanding between the parties regarding the preparation of the deed and causes ambiguity over the deed made, then the strength and usefulness of the notary deed needs to be questioned and also regarding the responsibility for the role of the notary who deliberately does not read the deed before the parties. In this study the aim is to examine further the role of the Notary in deed that is not read out before the parties and regarding the validity of the deed that is not read out. The research method used in this study is normative juridical, which is statutory research. It is carried out by examining problems using regulations that are related and relevant to the problem, in this case the rules that have to do with the field of notary law, namely UUJN and the Code of Ethics. Notary Public. The results of the study are that reading the deed is an obligation that must be carried out by a notary and if the notary's deed is not read out it will cause the deed to be null and void and the strength of proof becomes a private deed.

Abstract The writing of this article aims to determine the authority of a substitute notary in carrying out the duties and positions of a notary and to find out the responsibilities of a substitute notary when committing an unlawful act in making an authentic deed. This research examines empty norms using normative research methods, with a statutory approach, a conceptual approach and an analytical approach. The search for legal materials uses document study techniques, as well as analysis studies using qualitative analysis. The results of this research show that the responsibilities of a Notary Substitute are the same as that of a Notary Public, although they have different competencies, which can be seen through the requirement that a substitute Notary be appointed only with a Bachelor of Law graduates and have worked in a Notary Office. This cannot guarantee that the Substitute Notary will work properly and will not discriminate against the position of the Notary who has responsibility for the deed he made without a time limit and is not associated with the responsibility of the Notary being replaced. The principle of responsibility based on error is the basis for imposing sanctions on a Substitute Notary who is proven to have committed an unlawful act and is responsible for his actions in Civil, Criminal, code of ethics as well as administratively and is not associated with the responsibility of the Notary being replaced. Abstrak Penulisan artikel ini bertujuan untuk mengetahui kewenangan notaris pengganti dalam menjalankan tugas serta jabatan notaris dan untuk mengetahui tanggung jawab Notaris Pengganti apabila melakukan perbuatan melawan hukum dalam pembuatan akta autentik. Riset ini mengkaji norma kosong menggunakan metode penelitian normatif, dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan analisis. Penelusuran bahan hukum menggunakan teknik studi dokumen, serta analisis kajian menggunakan analisis kualitatif. Hasil riset ini menunjukkan bahwa tanggung jawab Notaris Pengganti sama dengan Pejabat Notaris meski memiliki kompetensi yang berbeda yang dapat dilihat melalui syarat diangkatnya notaris pengganti hanya dengan lulusan Sarjana Hukum dan pernah bekerja pada Kantor Notaris. Hal tersebut tidak dapat menjamin bahwa Notaris Pengganti akan bekerja dengan baik dan tidak mendiskriminasi jabatan Notaris yang memiliki tanggung jawab terhadap akta yang dibuatnya tanpa adanya Batasan waktu dan tidak dikaitkan dengan tanggungjawab Notaris yang digantikan. Prinsip pertanggungjawaban berdasarkan kesalahan merupakan dasar pengenaan sanksi kepada Notaris Pengganti yang terbukti melakukan perbuatan melawan hukum dan mempertanggungjawabkan perbuatannya secara Perdata, Pidana, kode etik serta pula secara administrasi dan tidak dikaitkan dengan tanggung jawab Notaris yang digantikan.

Abstract The purpose of this scientific article is to find out the arrangements related to the reading of authentic notary deeds and to analyze the juridical consequences of authentic deeds read by notary employees to the parties. This article is classified as a type of normative research that uses 2 types of approaches, namely the statutory and conceptual approaches. The arrangement regarding the reading of the Notary's Authentic Deed is contained in Article 16 paragraph (1) and letter m on article 16 which means that a Notary is obliged to read the Deed made in front of the parties - the parties in this case the parties making the Deed who are attended by witnesses. It’s very important that the deed is read in front of the parties - the party facing the parties and is an obligation based on the philosophical elements contained in the process of reading the deed. The juridical consequence of the authentic deed read out by the notary employee to the parties is the reading of the deed which is not carried out by the Notary but is carried out by the staff of the Notary to the parties as regulated in Article 16 paragraph (9) UUJN which in principle has the consequence that the authentic deed will be degraded into a deed. under the hand, which before the deed has perfect proof is no longer perfect. However, this legal consequence is exempted from the will deed as referred to in Article 16 paragraph (10) UUJN. Abstrak Tujuan daripada artikel ilmiah ini yaitu untuk mengetahui pengaturan terkait pembacaan akta autentik Notaris dan menganalisis konsekuensi yuridis dari akta autentik yang dibacakan oleh pegawai notaris kepada para pihak. Artikel ini tergolong jenis penelitian normatif yang menggunakan 2 jenis pendekatan yaitu pendekatan perundang-undangan dan konseptual. Pengaturan Terkait Pembacaan Akta Autentik Notaris termuat dalam Pasal 16 ayat (1) dan huruf m pasal 16 UUJN yang bermakna yaitu seorang Notaris diwajibkan untuk membacakan Akta yang dibuat dihadapan pihak – pihak penghadap yang dalam hal ini para pihak yang membuat Akta tersebut yang dihadiri saksi-saksi. Menjadi teramat penting akta dibacakan dihadapan pihak – pihak penghadap dan merupakan suatu kewajiban yang didasarkan kepada unsur filosofis yang terdapat pada proses pembacaan akta tersebut. Konsekuensi yuridis dari atas akta autentik yang dibacakan oleh pegawai notaris kepada para pihak yaitu pembacaan akta yang tidak dilakukan oleh Notaris namun dilakukan oleh pegawainya Notaris kepada para pihak sebagaimana diatur pada Pasal 16 ayat (9) UUJN yang pada prinsipnya memiliki konsekuensi bahwa akta autentik tersebut akan terdegradasi menjadi akta dibawah tangan, yang sebelum akta tersebut memiliki pembuktian yang sempurna menjadi tidak sempurna lagi. Namun akibat hukum ini dikecualikan untuk akta wasiat sebagaimana Pasal 16 ayat (10) UUJN.
