The existence of overlapping laws and regulations in the Intellectual Property Rights (IPR) sector creates conflicts in their implementation. For example, the obligation to mediate as a condition for carrying out criminal charges for copyright infringement is based on Article 95 paragraph (4) of Law Number 28 of 2014 concerning Copyright. Mediation provisions in Law Number 30 of 1999 concerning Arbitration are a way of settling civil disputes outside the court to settle by deliberation and consensus with the help of a mediator. Meanwhile, mediation based on Perma Number 1 of 2008 is intended as an obligation for judges at the first level court in the District Court and Religious Courts in the context of resolving civil disputes. Settlement of copyright disputes is the authority of the Commercial Court, as a special court within the general court environment. However, the Commercial Court does not apply the obligation of mediation. The study results indicate that the simplification of legislation in the intellectual property sector will result in quality, simple, orderly legislation that will also increase investment, create employment opportunities, reduce the burden on society and the efficiency of the state budget.Keywords: Simplification; Copyright; Criminal Act Settlement

This article aims to understand various efforts to improve public services through deregulation. For example, the Mayor of Pekalongan shared complaints from fishermen who felt that the existence of the state and government made it difficult because to take care of sea permits alone had to deal with 17 different agencies. The problem centers on the obstacles to improving public services through deregulation and the factors that cause overregulation in Indonesia. This study determined the obstacles to public services and over-regulation. The data used are secondary data collected through literature studies and analyzed qualitatively. This study concludes that the Government has made various efforts to improve intermediate public services through deregulation by enacting several laws and regulations that unify the material of previous laws and regulations. Overregulation occurs in Indonesia due to the unclear development of authority between various institutions. There are still many overlapping laws and regulations in regulating various affairs so the applicable regulations can be said to have been too many. Therefore, there needs to be a firm policy in the division of authority of regulators so that there is no more over-regulation because there are no more overlapping regulations.

Pandemi COVID-19 memaksa pemerintah untuk mengambil tindakan diskresiguna keselamatan masyarakatnya. Apabila persoalan ini tidak diperhatikan, maka akanmenimbulkan lebih banyak korban jiwa. Adapun rumusan masalah dalam penelitian iniyaitu: (1) Pengaturan terkait diskresi pemerintah di Indonesia; dan (2) Diskresi pemerintahakibat Pandemi COVID-19.Penelitian ini menggunakan tipe penulisan Doctrinal Research dengan menggunakanbahan hukum berupa bahan hukum primer, sekunder dan tersier. Teknik pengumpulanbahan hukum dilakukan dengan sistem kartu (card system) dan menggunakan pendekatanperundang-undangan, pendekatan fakta, dan pendekatan analisis konseptual.Hasil dari penelitian ini yaitu: Pertama, Pemerintah dalam fungsinya menjalankanpemerintahan, tindakan organ administrasi negara pada dasarnya dilakukan berdasarkanaturan yang dibentuk oleh organ administrasi negara tersebut dengan merujuk padaundang-undang. Namun dalam menyangkut beberapa hal, organ administrasi mempunyaikeleluasaan bertindak atas dasar kebijaksanaan yang disebut diskresi sebagaimana diaturdi dalam Pasal 1 Angka 9 Undang-Undang Nomor 30 Tahun 2014 tentang AdministrasiPemerintahan. Kedua, Diskresi dibenarkan dalam upaya penanganan persoalan yangmendesak dan membahayakan kepentingan umum, seperti misalnya kedaruratan kesehatanakibat pandemi. Pemerintah dalam hal ini lebih mengutamakan pencapaian tujuan ataumanfaat (doelmatigheid) daripada sesuai dengan hukum yang berlaku (rechtmatigheid)
