This study aims to photograph public awareness not to move in the red zone of the eruption of Mount Sinabung. Although the government has relocated victims of the eruption of Mount Sinabung and forbade people to carry out activities in the red zone of Mount Sinabung until now there are still many people who are active in the red zone area. The research is empirical legal research. The location of this research was in Gamber Village, Subdistrict of Simpang Empat, Karo Regency. Data that was collected will be analyzed by technique qualitative analysis. The people of Gamber village carry out activities in the red zone of Mount Sinabung consciously due to several factors. first, economic factor; second, the factor of agricultural land; and third, the belief factor. In addition to the three main factors, the government's inability to persuade its people persuasively not to carry out activities in the red zone also contributes to the violation of red zone policies. Looking at the various factors mentioned above, there are inefficient ways that can encourage people to maintain what is in effect.

Daerah perbatasan memiliki potensi terjadinya kerentanan masyarakat penerima manfaat dari pembangunan dan pemberdayaan kawasan. Jarak dan isolasi daerah berimplikasi pada akses pembangunan dan pelayanan dasar masyarakat. Realisasi mandat atas peran Kecamatan dalam UU Pemda dan PP Kecamatan sedapat mungkin dapat didorong untuk memastikan pembangunan berbasis HAM terwujud. Pengabdian Kepada Masyarakat (PKM) berfokus pada peningkatan kapasitas aktor pembangunan berbasis HAM di wilayah Kecamatan Besitang. PKM ini dilaksanakan dengan menggandeng mitra Pemerintahan Kecamatan Besitang untuk mewujudkan pembangunan berbasis HAM. PKM ini dilaksanakan dengan melalui tahap perencanaan, pelatihan, dan pendampingan. Peserta PKM terdiri segmentasi penting terkait tata kelola Pemerintahan Kecamatan Besitang. PKM dirancang melalui pendekatan partisipatif dengan paradigma pembangunan masyarakat (people centered development). Hasil pelaksanaan PKM peningkatan pemahaman dan keterampilan guna mendorong partisipasi masyarakat dan pemerintah untuk meningkatkan tata kelola pembangunan berbasis HAM di Kecamatan Besitang. Pemerintah dapat memahami dan mengintegrasikan standar dan prinsip HAM dalam pembangunan, pemberdayaan dan partisipasi di wilayah pemerintahannya. Warga dapat memahami partisipasi secara konseptual, bentuk dan mekanisme untuk berpartisipasi dalam pembangunan.

The subsidiarity principle in conducting local governance system in desa (village) has been adopted by Law No. 6 of 2014 concerning Desa. The law recognizes that Desa has the scale of local authorities and decisions to fully realize the villagers interests. However, in the situation of covid-19 pandemic concerns, Indonesian national government has been striving to prevent and overcome the pandemic and also enacted the emergency policies including economic and legal policies. In addition, for local governments including village must create and re-arrange the prioritized programs to be done effectively. This article examines the capacity of local government of Desa Pakam, Batu Bara, North Sumatra in conducting human rights-based approach to development (HRBA) during the pandemic. This article uses the legal research method and adopts normative juridical approach. Collecting data is gained by the secondary data, namely regulations, textbooks and journals. Beside it, data also obtained by interview with focused group discussion in the field. By using a conceptual framework of HRBA, this article analyses on the strategical ways in the implementation of the prioritized programs related to strengthen the resilience of villagers especially for disadvantage and vulnerable groups who are fully affected by pandemic. Actually, HRBA could improve the resilience for villagers and make comprehensive social protection according to human rights standards and mechanisms.
