The article provides and empirically tests an analytical model that considers the relationship between the discretionary power of street‐level bureaucrats (SLBs) and the institutional and organisational structures at meso and macro levels. The proposal maintains a bottom‐up perspective in the analysis of discretionary practices; at the same time, it highlights the relevance of multilevel governance systems as institutional spaces in opening and constraining the room for manoeuvre of SLBs. The analytical model is tested to comparatively analyse the implementation of the Italian guaranteed minimum income (Reddito di Cittadinanza) in two different regional welfare systems. The analysis focused on the practices and perceptions of the “navigators”, a new professional group introduced to implement the same policy. The fieldwork pointed out different spaces for and forms of discretion, highlighting that different institutional arrangements affect discretion and the variability of practices; however individual and professional group factors coupled with similar external constraints nuanced this variability with the emergence of common ones. In this article, the analytical model allowed to consider in a comparative perspective how institutional factors, besides individual and professional ones, influence discretion.

“…Zatímco pro anglosaské země je tradiční spíše tlak na rychlé (znovu)začlenění na trh práce (označovaný také jako "workfare") a pro kontinentální evropské země spíše podpůrný, zmocňující přístup, v posledním období se hranice mezi oběma přístupy rozostřuje 1 a i kontinentální evropské země kladou na nezaměstnané stále přísnější požadavky (blíže viz Brodkin a Larsen, 2013). Nezaměstnaným, zvláště pak nezaměstnaným příjemcům sociálních dávek, je připomínán požadavek reciprocity a individuální odpovědnosti za řešení jejich situace; je od nich požadována snaha a aktivní postoj (Serrano-Pascual, 2007). V opačném případě jsou vystaveni riziku sankce, typicky v podobě vyloučení z registru nezaměstnaných, které znamená nejen odepření přístupu ke službám zaměstnanosti, ale také k některým dalším opatřením sociálního státu (zejména k sociálním dávkám).…”

Active labour market policy emphasises applying an individual approach to the unemployed and understanding and acknowledging their individual needs. However, the staff at the Labour Office of the Czech Republic (PES), who are in direct contact with the clients, are also in charge of the administration of sanctions. Their agenda therefore combines both supportive and disciplinary roles. In this article, we examine how much discretion these frontline workers have in the area of sanctioning clients and how they exercise it. We analyse qualitative data from semi-structured interviews conducted at two contact local offices of the PES. The interviews revealed that job advisors use their discretion in favour of clients, i.e. they don't proceed with the sanctions despite violation of the rules by client (especially in the case of certain categories of clients and specific types of rule violation). Their decisions are influenced by their empathy, values, and professional experiences, and by the behaviour of clients and their history with the PES.
