Friedrich von Hayek’s classical liberalism argued that free markets allow individuals the greatest opportunity to achieve their ends. This paper develops an internal critique of this claim. It argues that once externalities are introduced, the forms of economic knowledge Hayek thought to undermine government action and orthodox utilitarianism also rule out relative welfarist assessments of more or less regulated markets. Given the pervasiveness of externalities in modern economies, Hayek will frequently be unable to make comparative welfarist claims, or he must relax his epistemic assumptions and allow for greater government action than his classical liberalism would wish to accept.

Many commentators have pointed out the presence of a tension, even a contradiction or inconsistency, between two theses advanced by Friedrich Hayek: that the growth of institutions ought to be spontaneous rather than consciously designed, and that the conscious design of a constitution is necessary, so as to secure a desirable social order. Our paper shows via textual analysis that, far from being irreconcilable, these two theses, on the contrary, complement each other.

Zu Beginn des 21. Jahrhunderts ist die ordnungspolitische Entscheidung weltweit zugunsten der Marktwirtschaft gefallen. Auch dem nichtökonomischen Beobachter der Weltszenerie wird jedoch auffallen, dass es sich um verschiedene Formen von Marktwirtschaften handelt. Als übliches Kriterium zur Typisierung der verschiedenen Formen dient das relative Ausmaß staatlicher oder korporativ organisierter Eingriffe in den Marktmechanismus und damit in die Privatinitiative. Daraus ergaben sich die geläufigen Unterscheidungen zwischen freier und gelenkter oder zwischen liberaler, sozialer und wohlfahrtsstaatlicher Marktwirtschaft (vgl. Kloten 1955; Leipold 1993).Diese Typologien finden im Zeitalter der Globalisierung ihr Pendant in der Unterscheidung zwischen dem Modell des freien marktgeleiteten Kapitalismus angloamerikanischen Musters (market-led capitalism), dem Modell des konsensual, korporatistisch und sozialstaatlich verfaßten Kapitalismus rheinischen, deutschen oder skandinavischen Musters (negotiated, consensual capitalism) und dem Modell des staatlich geleiteten Kapitalismus ostasiatischen Musters (state-led capitalism), das seinerseits in die Varianten des vertikalen Ichiban-Kapitalismus japanischen Musters und des netzwerkartigen Beziehungskapitalismus (crony capitalism) chinesischen Musters aufgeteilt wird (vgl.
