Race Equality and TCNs, or How to Fight Discrimination with A Discriminatory Law

Abstract: Two subjects often fit with difficulty in 'Fortress Europe': Equality and Third Country Nationals (TCNs). EC Law presents fundamental weaknesses with regard to TCNs in the intersections between race, religion and nationality discrimination. In particular for non-EU nationals, these three grounds of discrimination can be closely related, and difficult to distinguish. However, they are of great importance for the integration and fair treatment of migrants, which was one of the objectives of the Tampere Programm… Show more

“…50 There seems to be an idea in government circles that if one complies with the ECHR and EU law, than one also automatically complies with the standards in UN human rights treaties. Such a view, however, neglects that treaty standards and the interpretation of these standards by international courts or committees may differ (Lahuerta, 2009).…”

“…Both directives hold that the prohibition of discrimination ‘does not cover differences of treatment based on nationality’ (Recital of the Preamble and Article 3(2) of the Race Equality Directive; 12th Recital of the Preamble and Article 3(2) of the Framework Equality Directive). This kind of protection is reserved for EU nationals only (Lahuerta, 2009). Second, migration law falls outside the scope of the RED and FED.…”
