This study aims to delve deeper into the relationship between the executive and the judiciary in the context of separation of powers. Through a qualitative study approach, this study will analyze the dynamics of power and the role of law in influencing the interaction between the two branches of government. The research will involve in-depth interviews with legal practitioners, judges, executive officers, and other relevant stakeholders to gather in-depth qualitative data. Data analysis will be carried out by taking into account theoretical perspectives and concepts related to separation of powers, political power, judicial independence, and the role of law in the government system. The results of this study conclude that a better understanding of the dynamics of power and law in the relationship between the executive and the judiciary provides valuable insights for policymakers and law enforcers in strengthening the separation of powers and improving equitable governance systems.

Sistem pemerintahan Indonesia terdiri dari tiga lembaga utama yaitu legislatif, eksekutif, dan yudikatif. Tiap lembaga memiliki fungsi dan kewenangannya masing-masing agar kekuasaan tidak disalahgunakan. Prinsip negara hukum juga memerlukan adanya pengadilan yang independen dan tidak memihak, termasuk kemerdekaan kekuasaan kehakiman dan bebas dari intervensi dan pengaruh kekuasaan lain. Proses pemilihan hakim Mahkamah Konstitusi (“MK”) dari ketiga cabang kekuasaan, yaitu DPR (legislatif), Presiden (eksekutif), dan Mahkamah Agung (yudikatif) bertujuan untuk memastikan integritas, independensi, dan kontrol yang tepat. Secara normatif, baik DPR, Presiden, dan Mahkamah Agung tidak memiliki kewenangan untuk memecat Hakim MK yang telah diusulkan secara sepihak. Namun, pada 29 September 2022, DPR mencopot Hakim Aswanto dari MK dengan pertimbangan yang tidak dibenarkan konstitusi. Hal ini dapat merusak independensi peradilan dan tidak mencerminkan kekuasaan kehakiman yang merdeka. Penelitian ini bertujuan untuk menganalisis polemik legalitas pemecatan Hakim Aswanto dan implikasinya terhadap kemandirian kekuasaan kehakiman di Indonesia. Metode yang digunakan adalah penelitian hukum normatif yang mengacu pada bahan kepustakaan (library research) dan pendekatan perundang-undangan (statute approach). Hasil penelitian menunjukkan bahwa pencopotan Aswanto tidak sesuai dengan pasal 23 ayat (4) UU MK dan pemerintah harus memastikan bahwa segala keputusan MK didasarkan pada hukum dan konstitusi, bukan kepentingan politik atau kekuasaan. Sebagai "guardian of constitution", MK merupakan roh dari negara hukum dan eksistensi kemerdekaan kekuasaan kehakiman menjadi sangat penting.

The formulation of procedural law within the constitutional court is a crucial requirement, as stipulated by Article 24 C paragraph (6) of the 1945 Constitution of the Republic of Indonesia. While the Constitutional Court Procedural Law is outlined in Law No. 24 of 2003 on the Constitutional Court, it merely provides general points. Special aspects, aligned with individual case characteristics, are deferred to the Constitutional Court for independent regulation based on Article 86 and the Explanatory Note to Law No. 24 of 2003. However, this delegation is inappropriate as procedural law should be governed by Law-level regulations, not by Constitutional Court Regulations (PMK). To date, the Constitutional Court continues to produce the Procedural Law in the form of PMKs. This study employs a normative juridical research method, with a statutory and conceptual approach, and conducts analysis in a qualitative descriptive manner. This paper concludes, firstly, that the creation of procedural law within the constitutional court holds philosophical, juridical and sociological significance. Secondly, the drafting process of the constitutional court’s procedural law must adhere to the process of forming sound laws and regulations and contain materials in line with their level as prescribed in the legislation.
