The current job transformation is one of the challenges for the state of Indonesia. Crimes over time have been carried out systematically, including corruption. The interesting thing about the development of efforts to combat corruption is the development of the concept of returning state finances. Legal entities in Indonesia have long experienced legal pluralism, as can be seen from the configuration of the community that carries out Islamic criminal law and customary law as local wisdom. This study uses a normative approach with secondary data support with the specification that the confiscation of corruptor's property in Islamic criminal law is divided into: Reproaches and reprimands/warnings, dismissing from his position (al-azl min al-wadzifah), by beating (whipping), punishment in the form of property (fines) and physical punishment, exile, crucifixion, death penalty. The relevance between these concepts is a form of legitimacy for the legal significance that comes from the beliefs and needs of the community. This article raises the concept of positive law with concepts in Islamic criminal law to find the relevance of the two which will later become part of the effort to function Islamic criminal law into Indonesian positive law in order to achieve the goal of a fair law and reduce corruption.

AbstrakAdvokat merupakan profesi yang paling rentan menjadi Gatekeeper dalam tindak pidana pencucian uang. Sesungguhnya profesi advokat merupakan bagian dari aparat penegak hukum yang dapat berkontribusi lebih baik dalam mencegah aktifitas pencucian uang untuk berkembang. Penegasan mengenai peran advokat yang dapat menekan terjadinya tindak pidana pencucian uang, yaitu dengan diterbitkannya PP No. 43 Tahun 2015, yang menempatkan advokat sebagai salah satu pihak pelapor dalam agenda pemberantasan tindak pidana pencucian uang. Namun, substansi dari peraturan tersebut menuai kritik dari sebagian advokat yang salah dalam mengintepretasi maksud dan tujuan pengaturan tersebut. Terlebih lagi ada sebagian advokat yang menilai bahwa peraturan tersebut bertentangan dengan peraturan yang mengatur hak imunitas pada profesi advokat. Misinterpretasi dari sebagian advokat terkait dengan hak imunitas yang melekat pada profesinya tersebut, menyebabkan hasil kerja dari profesi advokat dinilai tidak relevan, dan tidak pantas disebut sebagai profesi yang luhur (Officium Nobile), melainkan sebagai profesi yang buruk dalam integritas dan mengedepankan komersialisasi ntegritas dan mengedepankan komersialisasi. Sesungguhnya, tujuan dasardari pengaturan pada PP No. 43 Tahun 2015, yang menempatkan profesi advokat sebagai salah satu pihak pelapor dalam agenda pemberantasan tindak pidana pencucian uang, adalah suatu bentuk penghormatan terhadap profesi advokat yang merupakan profesi mulia, dengan mengedepankan tanggung jawab profesinya pada negara, masyarakat dan Tuhan, serta kewajibannya sebagai bagian dari profesi hukum untuk menegakkan hukum dan menjunjung tinggi nilai hak asasi manusia saat bertugas.

The rise of illegal wildlife trade threatens Indonesia's biodiversity. This was compounded by the development of an increasingly organized and transnational mode of perpetrators of crime. Therefore, it is necessary to carry out optimal and up-to-date law enforcement efforts for illegal wildlife traffickers, particularly by the Civil Servant Investigator at the Directorate General of Customs and Excise. The results of this study indicate the urgency of optimizing the role of customs and excise PPNS in handling customs cases of trade in protected animals because of the increase in protected wild animals that are threatened with extinction; weak strength of evidence of illegal wildlife trade cases at the trial; and the development of an illegal wildlife trade crime mode. Then the optimization efforts can be made by pursuing assets of perpetrators of crime, the use of electronic evidence, and strengthening the cooperation of national and multi-national institutions. So hopefully with these efforts, the purpose of this writing, namely the handling of protected wildlife trade cases run optimally by PPNS Directorate General of Customs and Excise. This research is a qualitative normative juridical research study using a statute approach, a case approach, and a comparative approach.Keywords: Biodiversity, Trade, Animals, Protected. ABSTRAK: Maraknya perdagangan satwa liar ilegal mengancam keanekaragaman hayati Indonesia. Hal itu ditambah dengan berkembangnya modus pelaku kejahatan yang semakin terorganisir dan transnasional. Oleh karena itu, perlu dilakukan upaya penegakan hukum secara optimal dan mutakhir kepada para pelaku perdagangan satwa liar illegal, khususnya oleh Penyidik Pegawai Negeri Sipil Direktorat Jenderal Bea dan Cukai. Hasil penelitian ini menunjukan urgensi optimalisasi peran PPNS Bea dan Cukai dalam penanganan perkara kepabeanan perdagangan satwa dilindungi karena meningkatnya satwa liar dilindungi yang terancam punah; lemahnya kekuatan pembuktian perkara perdagangan satwa liar illegal di persidangan; dan berkembangnya modus kejahatan perdagangan satwa liar ilegal. Kemudian upaya optimalisasi tersebut dapat dilakukan dengan pengejaran aset pelaku kejahatan, pemanfaatan bukti elektronik, dan penguatan kerjasama lembaga nasional maupun multi nasioanl. Sehingga diharapkan dengan upaya tersebut, maka tujuan penulisan ini, yakni penanganan perkara perdagangan satwa liar dilindungi berjalan optimal oleh PPNS Bea dan Cukai. Penelitian ini merupakan penelitian hukum yuridis normatif kualitatif dengan menggunakan pendekatan undang-undang (statute approach), pendekatan kasus (case approach), dan pendekatan komparatif (comparative approach).Kata Kunci: Keanekaragaman Hayati, Perdagangan, Satwa, Dilindungi.
