RESUMO Na primeira parte do ensaio, o autor argumenta que as linhas cartográficas "abissais" que demarcavam o Velho e o Novo Mundo na era colonial subsistem estruturalmente no pen-samento moderno ocidental e permanecem constitutivas das relações políticas e culturais excludentes mantidas no sis-tema mundial contemporâneo. A injustiça social global estaria portanto estritamente associada à injustiça cognitiva global, de modo que a luta por justiça social global requer a construção de um pensamento "pós-abissal". SUMMARY In the first part of the essay, the author states that the "abys-sal" cartographical lines that used to demarcate the Old and the New World during colonial times are still alive in the structure of modern occidental thought and remain constitutive of the political and cultural relations held by the contemporary world system. Global social iniquity would thus be strictly related to global cognitive iniquity, in such a way that the struggle for a global social justice requires the construction of a "post-abyssal" thought. O pensamento moderno ocidental é um pensa-mento abissal 2. Consiste num sistema de distinções visíveis e invisí-veis, sendo que estas últimas fundamentam as primeiras. As distin-ções invisíveis são estabelecidas por meio de linhas radicais que dividem a realidade social em dois universos distintos:o "deste lado da linha" e o "do outro lado da linha".A divisão é tal que "o outro lado da linha" desaparece como realidade,torna-se inexistente e é mesmo pro-duzido como inexistente. Inexistência significa não existir sob qual-quer modo de ser relevante ou compreensível 3 .Tudo aquilo que é pro-duzido como inexistente é excluído de forma radical porque permanece exterior ao universo que a própria concepção de inclusão considera como o "outro". A característica fundamental do pensa-mento abissal é a impossibilidade da co-presença dos dois lados da linha.O universo "deste lado da linha" só prevalece na medida em que esgota o campo da realidade relevante: para além da linha há apenas inexistência,invisibilidade e ausência não-dialética. This paper considers the implications for the community legal sector of the Australian Government's recent national security and anti-terrorism legislation. Critics of the legislation have deep concerns that, by giving the police and intelligence services considerable new powers in the areas of arbitrary arrest and detention, it will lead to the significant erosion of rights and freedoms that Australians have long been able to take for granted. Other concerns with the legislation relate to the use of force, sedition, and legal representation for those held in preventative detention. In addition, the legislation has no adequate protection against the intelligence services and police misusing or abusing their new, extended powers. Community legal centres (CLCs), that comprise the community legal sector, have the important role of informing citizens of their basic rights and assisting them in exercising these rights in their dealings with government and its agencies. This paper will consider what effects the anti-terrorism legislation will have on the community legal sector's effectiveness in playing this role. The sector, which the Australian government relies on and funds to provide legal services to some of the most disadvantaged members of the Australian community, has as its raison d'être improving access to justice and equality before the law for all Australians. The paper will also consider the impact of the anti-terrorism legislation on the relationship between the government and the sector.
