This investigation is pertinent as it illustrates that legal norms play a dual role—safeguarding the adherence to human rights and freedoms while concurrently imposing specific constraints and, in certain instances, transgressions upon them. The objective of this article is to scrutinize the theoretical and practical dimensions surrounding the influence of law on human rights and civil liberties. It aims to analyze the legal framework and confront pertinent issues by delving into both national and international legislative practices. The focus is on regulatory and legal framework governing the impact of law on human rights and civil liberties. The utilized methodologies encompassed the historical method, structural and functional method, analytical method, comparative method, statistical method, and sociological method. The presence of a legislative rule without effective implementation or with implementation in contravention of rights and civil liberties poses a significant challenge. Resolving current issues demands concerted efforts, rendering this problem of paramount importance and warranting further research and examination. Each state is tasked with harmonizing its national legislation with internationally ratified instruments at both the regulatory and practical levels. A comprehensive exploration of the practical and theoretical dimensions of gaps in legislative processes as a pressing global issue in Ukraine is imperative to ensure the observance of rights and freedoms, and to mitigate the adverse consequences arising from the negative impact of law.

The work deals with the issues of determining the balance of private (individual) and public (state) interests in terms of admissibility of limiting human rights and freedoms in cases where it increases or prevents threats to national security. This was the aim of the study, as this issue has become highly relevant because of the growing number of hybrid threats to national security, which can be countered through the introduction of separate restrictions on human rights by the state. The systemic approach, the hermeneutic, and doctrinal approach were used to conclude that almost all constitutions, constitutional acts and constitutional laws of the EU and NATO member states provide for the possibility of restricting human rights. Such restrictions are imposed for the purposes of national security, public necessity or national interests of the state. Moreover, the list of cases where the restrictions on civil rights may be applied in the national security interests in national legislation is often much wider than in international legal acts. This demonstrates the primacy of national interests over individual interests, which is defined by national legislators as the common good at the constitutional level. The lack of detailed cases and models of state response to these processes determines the conclusions on the need to introduce a system of legally determined conditions for the application of restrictive measures. That is why further research should focus on identifying and detailing the criteria for applying measures to restrict civil rights for the purposes of national security at the constitutional level. Згідно з міжнародним та національним законодавством, кожна людина має право на відновлення порушених прав та свобод, у судовому порядку. Сьогодні, коли відбулося, воєнне вторгнення росії на територію України, судова система, у зв’язку з воєнними діями, може працювати неефективно. А населення, через напружену ситуацію, може ігнорувати чи взагалі не звертатися за захистом своїх прав. Якщо людство знає основи законодавства, звичайно, завжди воно буде шукати й шляхи захисту від протиправних дій та намагатиметься захистити свої законні людські свободи та правові норми. Тема є актуальною та важливою сьогодні, адже необхідно кожному розуміти етапи судового процесу. Хто як не держава може надати такі гарантії. Процесуальним правом в кожному окремому випадку закріплюється процес розгляду справ у судовому порядку, але важливо покращити правову обізнаність населення, щодо можливості правового захисту своїх прав, незалежно від зовнішніх та внутрішніх чинників. Важливим є аналіз національної та зарубіжної джерельної бази, щодо процесу здійснення судочинства. Мета. Метою статті є теоретико-правовий аналіз та вивчення етапів судового процесу: розгляду справи в суді. Матеріали та методи. Матеріалами дослідження є: теоретико-правові національні та міжнародні наукові здобутки. Використовуються загальнонаукові та спеціальні методи наукового пізнання. Важливу роль займає юридичний метод. Використано метод узагальнення, опису, аналізу, структурно-функціональний метод при ознайомленні з основною літературою. Застосовано порівняння та зустрічається прогнозування, при удосконаленні обізнаності судочинства в майбутньому. Результати. У результаті наукового, теоретико-правового аналізу розкрита джерельна база, узагальнено наукову літературу, внесено актуальні авторські пропозиції, щодо удосконалення обізнаності населення щодо судового захисту своїх порушених прав, в умовах воєнного часу, та внесені положення про дослідження позитивного зарубіжного досвіду та впровадження в практичну діяльність в Україні. Перспективи. Теоретико-правовий аналіз та вивчення етапів судового процесу: розгляду справи в суді, надає можливість, з’ясувати актуальні, ключові проблеми сучасності та знайти шляхи їх вирішення глобально і в майбутньому продовжити розгляд на науковому рівні авторських пропозицій та впровадити їх в практику.
