Sexual harassment is often a problem in social life in Indonesia. The reason is that according to legal records, violence against girls (KTAP) has increased by 2,341 cases, compared to 1,417 the previous year. The increase from the previous year was 65% and the most cases were cases of incest and added to cases of sexual violence (571 cases) while sexual violence against women with disabilities increased by 47% compared to last year and the most victims were intellectual disabilities. Sexual harassment can be in the form of inappropriate behavior or rape. According to WHO in 2006 every day in the world there are women who are harassed, raped or beaten. The Indonesian Criminal Law (KUHP) which regulates this does not have a proper function, because the rules contained in it are incomplete on this issue. Sexual harassment may not cause physical pain and the like, but it can be emotionally harmful. It is very often that sexual harassment cannot be caught because Indonesian laws are imperfect in dealing with this issue. The concept of harassment in Indonesian law has reduced the significance of the harassment experienced by the victim, and therefore cannot bring justice to the victim.

Penelitian ini bertujuan untuk mengungkap karakteristik kekerasan seksual yang dialami oleh perempuan di Perguruan Tinggi Negeri Kota Makassar. Pengumpulan data dilakukan dengan menggunakan angket dan dokumentasi. Analis data dilakukan secara statistic deskriptif presentatif dengan analisis univariat yang berfokus kepada Variabel tunggal. Untuk mengolah data, peneliti menggunakan alat SPSS 23.0. Hasil penelitian menunjukkan ada empat bentuk kekerasan seksual yang dialami oleh perempuan di perguruan tinggi negeri Kota Makassar yaitu: pesan lelucon gambar foto audio atau video yang bernuansa seksual sebesar 94%, Ditatap oleh seseorang dengan nuansa seksual dan atau tidak nyaman sebesar 93%; Dirayu dengan lelucon dan atau siulan yang bernuansa seksual di lingkungan kampus sebesar 90% dan Mendengar ujaran yang mendiskriminasi atau melecehkan tampilan fisik kondisi tubuh dan atau identitas gender sebesar 85,2 persen. Adapun pelaku kekerasan seksual pada perempuan diperguruan tinggi negeri Kota Makassar adalah senior sebesar 46 persen dari jumlah responden, teman Angkatan 45 persen, tenaga kependidikan 4 persen dan dosen 3 persen. Adapun factor penyebab terjadinya kekerasan seksual pada perempian di perguruan tinggi negeri di Kota Makassar adalah; menganggap kekerasan seksual adalah hal yang biasa 43 %, budaya Victim blaming yang pernah terjadi sebelumnya 30 % dan relasi kuasa antara pelaku dan korban 26 %.

The Regulation of Minister of Education, Culture, Research and Technology (Permendikbud) 30/2021 is a response to the high level of sexual violence case perpetrated by individuals in universities in Indonesia. The existence of a victim's consent instrument in Permendikbud 30/2021 as a differentiator between sexual violence and a consensual relationship is a new thing in legal regulation in Indonesia. This research aims to explain the concept of retractable consent and its application in Permendikbud 30/2021. This study uses a descriptive analysis method to data sources on regulations that are considered relevant to the agreement of the parties in general, and regulations related to sexual violence in particular. The results show that retractable consent in cases of sexual violence is the consent of one of the parties involved in sexual activities that can be withdrawn or canceled at any time, even when sexual activity has started. In this concept, the agreement has the nature of sustainability. Permendikbud 30/2021 regulates the invalidity of consent with certain conditions, so that the consent given by one of the parties in a sexual activity can be considered legally invalid. According to Permendikbud 30/2021 victims of sexual violence who apply personal consent retraction (cancellation or withdrawal of consent for personal reasons) should also be included in the victim category.
