This article analyzes the liability that may arise in case of refusal to receive a COVID-19 vaccine shot, as well as vaccination-related problems in Ukraine and worldwide. We focused on the international and Ukrainian situation regarding the COVID-19 vaccination process. We also considered the legal framework on this issue. The main task of the study was to determine whether there is a liability, including criminal liability, for refusing to receive the COVID-19 vaccine, the nuances, and the legal basis of this process. The research methodology includes general scientific and special scientific methods, such as systemic, structural, formal-legal, hermeneutic, and methods of analysis and synthesis. We found that COVID-19 vaccination is currently voluntary but not mandatory in Ukraine. At the same time, according to legal documents, vaccination against several diseases such as diphtheria, pertussis, measles, polio, tetanus, and tuberculosis is mandatory. Practically, this means that those who are subject to such preventive vaccinations may be subject to sanctions in the form of dismissal for refusing to vaccinate. Only a few foreign countries currently use mandatory COVID-19 vaccination for the entire adult population. More common is mandatory vaccination of certain categories of workers, including health workers, social workers, essential workers, civil servants, and others who are in close contact with people or whose health and well-being are of particular importance to national security.

Research background: The cultural and creative industries are one of the main drivers of the economy throughout the European Union. There is a strong competition in the creation of creative products or services. Current protection of the creation of given products and services helps to prevent mistakes that can often have liquidating consequences for artists. There is a lot of competitive pressure on social networks. It is therefore necessary for these artists to be made aware of the protection of their work, in which they have invested their time, funds and efficiency with regard to the protection of intellectual property to gain a very important role in their industry. Purpose of the article: The main purpose is to point out the use of intellectual industry rights in a selected branch of the creative industry - in the sector of specialized design activities based on questionnaire survey realized at first half of this year. Methods: The basic methods that were used in the processing of the paper include generally applied methods such as analysis, synthesis, induction or deduction. In the application part of the presented paper, we used the results of a questionnaire survey among companies operating in the field of specialized design activities. Findings & Value added: As the added value can be considered the assessment of the state of worldwide-used intellectual property protection among companies in the selected sector of the creative industry, which was significantly affected by pandemic Covid-19. Another conclusion is the proposal of possible solutions to increase the protection of their intellectual activity.

PurposeThis paper aims to provide an integrated legal and marketing perspective on the imminent trademark challenges and opportunities for sports organizations operating in the metaverse.Design/methodology/approachThe approach is a legal commentary that explores the ways in which the current legal framework, especially in the context of trademarks, might need to transform to offer robust protection for sports brands in the virtual marketplaces emerging within the metaverse.FindingsOur analysis reveals that the traditional legal frameworks for trademarks are often inadequate to address the unique challenges posted by the metaverse, such as the issue of virtual goods replication and the global accessibility of branded content. The findings indicate that sport organizations must adopt proactive strategies to monitor and enforce their trademark rights effectively within these expansive digital environments. Moreover, legislative bodies may need to consider reforms or new regulations specifically tailored to the complexities of trademark protection in the digital realm to prevent dilution and misuse of sport brands.Originality/valueIn light of legal and branding issues related to metaverse-based trademarks, this paper is dedicated to examining the legal principles and foundations necessary to enhance the protection of sports brands within the virtual marketplace of the metaverse.
