De Mariana a Brumadinho: a efetividade da responsabilidade civil ambiental para a adoção das medidas de evacuação

As atividades exploratórias de recursos minerais originam resíduos que carecem de um local apropriado para serem armazenados. No Brasil, as barragens de rejeitos são vistas como alternativa de armazenamento desses resíduos. Uma associação entre erros, tanto na implementação quanto na fiscalização desse modelo, acarreta falhas que podem desencadear desastres ambientais. Os rompimentos das barragens situadas nas cidades mineiras de Mariana e Brumadinho ocasionaram danos ao meio ambiente e à sociedade. Uma vez que eles se enquadram como crimes ambientais e como crimes não transeuntes (que deixam vestígios), de acordo com o ordenamento jurídico brasileiro vigente, o trabalho da perícia criminal torna-se indispensável. Dessa forma, o presente trabalho teve como objetivo, a partir de uma revisão bibliográfica sistemática, apresentar e discutir os achados referentes às tragédias de Mariana e Brumadinho associados ao trabalho pericial. Percebeu-se a ausência de publicações científicas que abordassem essa associação. Apenas um laudo elaborado pela Polícia Federal foi encontrado.

Companies involved in socio-environmental tragedies have increasingly aroused the interest of society and regulatory bodies. In this sense, the cases of the companies Samarco S.A. and Vale S.A. stand out in the Brazilian context due to the socio-environmental impacts they caused in the regions where they operate. Thus, this research aimed to analyze the actions of social legitimacy according to Suchman's typology (1995) evidenced by the companies Samarco S.A. and Vale S.A., after the Mariana disasters in 2015 and Brumadinho in 2019. Therefore, it is classified as qualitative and the Content Analysis applied to the Management Report (RA) and Notes was used as a methodology to answer the research problem. Explanatory Notes (NE) of the Financial Statements (DF). The period of analysis of Samarco S.A. was from 2015 to 2020; the analysis of Vale S.A., on the other hand, covered the years 2019 and 2020. The main results infer that the analyzed companies intended to gain general legitimacy in the analyzed period. This legitimacy is used as an action or strategy when the company incurs an event with a negative connotation and needs to ensure the continuity of its operations. Furthermore, in the cases of Samarco and Vale, it is clear that the events related to the tragedies were reported superficially and without effective recognition of the guilt of those responsible.

Natural trails in UNESCO Global Geopark territories show strong salutogenic, inclusive and interactive characteristics as potentials and opportunities for ecosystem health. It is essential to provide information to inform the hiker as to the characteristics of the environment and the attractions and challenges of the route. Based on a network analysis methodology we aimed to identify the indicators of centrality and strength of connection in order to classify the effort index and biomechanical overload of the Araripe UNESCO Global Geopark trails in Brazil. The results showed strong connection and centrality of the variables related to the biomechanical overload in the effort index. In the trail of Pontal de Cruz the altimetric variation and the surface of the ground are highlighted in the biomechanical overload that presented a horizontal course equivalent 2.6 times larger than the presented distance. In Sítio Fundão trail, the surface of the ground also stood out, increasing the exposure in 36% of the presented distance. On the Missão Velha Waterfall trail, the variable that stood out was the biomechanical overload on the knee, equivalent to a horizontal increase of 28% of the measured distance. The methodology presented sought to optimise the mapping, management and consolidation of a network of natural trails aggregated to a high geotouristic, scientific, educational, cultural and well-being potential as presented in the Araripe UGG territory.
