RESUMOO presente artigo objetiva analisar o federalismo ambiental na Austrá-lia e na Índia, com suas configurações e particularidades, resultantes de dados populacionais e culturais e dos processos históricos de criação de cada Estado federal. Como resultado, observou-se que a maior ou menor centralização é resultado de uma série de fatores que passam do processo de formação do Estado às tensões internas geradas pela própria dinâmi-ca política, econômica e social do país. Na Índia, nota-se uma tendência de centralização da competência ambiental, seja por meio legislativo, por interpretação judicial ou, ainda, pela criação de agências federais com atribuições sobre o meio ambiente. Na Austrália, a Constituição não dispõe sobre competências federativas ambientais, o que, diferentemente da regra constitucional indiana, seria de atribuição dos Estados. Entretanto, o ativismo judicial no tema do meio ambiente é um traço comum aos dois países analisados.Palavras-chave: Federalismo ambiental; Índia; Austrália.
