Abstract. Owing to the increasing existence of multistorey buildings and infrastructures in the built environment, there is a need for three-dimensional (3D) land administration systems (LAS). Regarding this, condominium rights in real-estate properties are needed to be represented as 3D for preventing misinterpretations with regards to who is responsible for or has ownership in which parts of the buildings. Digitalizing the public services appears in current strategies of governments and administrations since it contributes to transparency, speed, and accurateness in the processes. Building permitting that contains obtaining the occupancy permit is a vital one of these public services. With the even-increasing adaptation of Building Information Modelling (BIM), a whole raft of Building Information Models (BIMs) are created to use in digital building permitting. Thus, a significant opportunity for 3D delineation of condominium rights comes out of the reuse of these BIMs, especially their Industry Foundation Classes (IFC) data. In this sense, this paper puts forward an approach that includes developing the conceptual model to depict condominium rights and linking that model with the IFC schema. The applicability of the approach is demonstrated by using a floor of a simple building. The study shows that IFC-based representation of condominium rights can be beneficial for the transition to 3D LAS in Turkey.

Legal Framework of Urban Underground Space in China

The booming of three-dimensional (3D) land use brings a change of the connotation of land rights, which will expand “flat” 2D land legislation with 3D land legislation. The legal issues of urban underground space for 3D objects in large cities around the world have been attracting more and more attention. A supportive legal framework is crucial for underground space utilization in a country. This paper analyzes the present 173 representative laws and regulations of urban underground space utilization and management of China from 1998 to 2018, and attempts to interpret the current laws and regulations of underground space from four aspects; by quantity, spatial distribution, legislative force and content. The result shows that poor legal framework of urban underground space in China, including low-level of legislative force, disunity of local legislation standard and absence of special statutes and regulations, are the main reasons causing ownership disputation, registration chaos, as well as no unanimous judicial practice. To address these issues, the paper refers to a case study for underground space legal framework in Japan and aims to form a set of top-down unified legal framework, including basic law, special statutes and regulations, as well as supplementary policies and documents of urban underground space, and proposes that the underground space planning should be incorporated as one essential portion of the master planning in China. By studying the legal system of underground space in Japan and China, this study may offer better insight for those conducting UUS legal framework research as well as serve as reference for countries with similar legal issues.

Cadastral surveying plays an important role in defining legal boundaries of land and property. The current practice for recording cadastral survey data mainly relies on 2D digital or analog documents. This practice is efficient for simple land parcels but can be challenged in complex building developments. To address the issues stemmed from 2D methods of representing cadastral survey data, 3D spatial information models can be considered as a viable solution for managing cadastral survey data. Building Information Modeling (BIM) enables colsslaborative 3D management of the design, construction, and operation of buildings. There have been extensive studies conducted to investigate the connectivity between BIM and 3D cadaster. Most of these studies focus on managing legal information, such as ownership boundaries and attributes, in BIM-based environments. However, there is limited investigation on how surveying measurements can be mapped into BIM. In this study, the proposed method for integrating the cadastral survey data into the BIM environment includes identifying cadastral survey requirements, using BIM entities relevant to cadastral survey data, enrichment of a BIM prototype, and evaluation of the prototype. The major contribution of this study is to demonstrate the storage of cadastral survey data such as survey marks and traverse lines in the BIM environment. Therefore, this research contributes to the further enrichment of BIM with incorporating data elements related to cadastral surveying practices. It is confirmed that current BIM-based tools provide restricted capabilities for explicit management and visualization of cadastral survey data. This limitation can be addressed in the future enhancements of BIM in terms of supporting important elements for cadastral survey data.
