RESUMOEste artigo objetiva apresentar uma discussão teórica sobre os perigos dos alimentos industrializados e da comida consumida em restaurantes composta com nitrato de sódio e de potássio, conhecidos como "salitre". O trabalho estuda informações científicas e jurídicas a fim de verificar eventual falta de clareza legislativa. O método utilizado foi o dedutivo legal, atribuindo-se interpretação de textos legais, doutrinários e jurisprudenciais. Conclui-se que há uma celeuma entre a conduta dos fornecedores e a legislação quanto aos riscos significativos à saúde do consumidor, somada à inércia das autoridades, para considerar como crime inerente à relação de consumo oferecer alimentos com salitre aos consumidores, de modo que o Código Penal não versa diretamente sobre esse assunto, constatando-se a necessidade urgente dos órgãos e autoridades brasileiras atuarem com maior rigor e aprimorarem o ordenamento jurídico. PREDICTION LACK OF LEGAL IN PARTICULAR SALITRE USING THE FOOD: A THREAT TO CONSUMER HEALTH
ABSTRACTThis article presents a theoretical discussion about the dangers of processed food and food consumed at restaurants possibly with sodium nitrate and potassium, known as "saltpeter". The paper studies scientific and legal information to verify a possible lack of clarity legislative. The method used was the legal deductive, attributing interpretation of legal texts, doctrines and jurisprudence. It is concluded that there is a stir between the conduct of suppliers and legislation regarding the significant risks to consumer health, combined with the inertia of the authorities to consider as a crime inherent to consumer relations offer foods with saltpeter to consumers. However, the Brazilian Penal Code does not concerns directly on this matter, noting the urgent need for organs and Brazilian authorities act with greater accuracy and hone the legal system.
