This case study analyzed citizen participation at the Municipal Health Council (MHC) of Ribeirão Preto, in the state of São Paulo (Brazil), using a qualitative approach with a phenomenological basis and methodological triangulation: (i) analysis of the minutes of the meetings, (ii) passive observation, and (iii) semi‐structured interviews with councillors. The interviews were analyzed using content analysis and categorized according to three themes: (i) challenges and limitations of participation in the MHC, (ii) representativeness of the councillors, (iii) the Council and its influence on local health‐care policies. Problems with infrastructure and the organizational logistics of the MHC, as well as relational difficulties among members occupying varied roles and having different levels of knowledge about health, influenced the quality of the deliberative process. In contrast to studies that indicate poor participation by health‐care service users in spaces of dialogue around health‐care policies, this study found the users actively engaged and committed.

Comparison between federal Brazilian legal frameworks in the areas of health and sanitation, from the perspective of participation, is the thread of this work, considering the pioneering of health and its possible influence on sanitation. The comparative effort was made from six analytical criteria: defined social control mechanisms; character given to social control; responsibility, recommendations and support to enable social control; access to information; control over the use of resources; control of the implementation of the resolutions. It was evaluated if the sanitation framework have been helped by health formulations and if have achieved produce more effective practices of social control in the conduct of public policy. The results show that, although it has received some influence from the health area, the water and sanitation framework is more restricted and has less potential to produce more effective practices, since it presents: 1) more restrictive mechanisms because they are not necessarily deliberative; 2) lack of a policy of training counselors and popular education to incentive participation; 3) absence of effective mechanisms for monitoring the use of resources.

<p>Os conselhos municipais de saúde são instâncias de participação cívica na gestão do Sistema Único de Saúde (SUS), criados a partir da Lei nº 8.142 de 28 de dezembro de 1990. Fixam-se assim os espaços para participação popular na agenda pública, especificamente na saúde, conferindo caráter diferenciado à gestão municipal, que se assume como controle social. Nesse contexto e mediante o papel e as responsabilidades atribuídas aos conselhos, este trabalho tem a proposta de analisar o exercício do controle social exercido pelo conselho municipal de saúde na cidade de Juiz de Fora. Para tanto, realizou-se uma revisão de literatura a fim de fundamentar esta pesquisa e auxiliar no tratamento de dados. Com relação aos procedimentos metodológicos, este estudo, de abordagem qualitativa, empregou como técnicas de coleta de dados a realização de entrevistas semiestruturadas, pesquisa documental e observação não-participante, sendo os dados estudados a partir da análise de conteúdo. As análises sugerem incompletude na autonomia do conselho, ao identificarmos traços de heteronomia.</p>
