Legal regulation of crossborder protection of intellectual property rights at the present stage, the level of international, national and supranational law. These levels are characterized by the mutual influence on each other. International standards on cross-border protection of intellectual property rights have a significant impact on the formation and development of national legislation in this field. In the context of international integration in the Eurasian economic space is increasingly important to the supranational level through regulation of the legislation of the Customs Union.
At the present time customs control after the release of the goods is the priority for the customs authorities in consideration of Customs Union and the formation of the Eurasian Economic Space. The procedure of customs control after the release of the goods in the Customs Union of Russia, Belarus and Kazakhstan is regulated at the international, regional and national levels. Despite the processes of unification of the regulation of follow-up customs control in the Customs Union, some differences in the timing and the manner of its implementation still exist in the member states of the Customs Union. Harmonization and unification of regulation and enforcement in this area will improve the efficiency of customs control after the release of the goods in the Customs Union.
Purpose: The purpose of the article is to determine the role of customs' control and directions of its improvement in the movement of genetically modified foods across the customs' border of the Eurasian Economic Union. In carrying out the study, the authors rely on the methods of theoretical modeling and interpretation of legal concepts and normative legal acts, which allowed to identify theoretical and applied problems of customs control in the conditions of Eurasian integration. Design/Methodology/Approach: The authors define the concepts of genetically modified foods and their turnover, highlight the problems of customs control over the movement of genetically modified foods across the customs border of the Eurasian Economic Union, and propose ways to improve it. Practical Implications: The results may be implicated into a legal framework of Russian Federation and improve customs' regulation both in Russia and abroad. Originality/Value: The main contribution of this article is the comprehensive analysis of legal and institutional background of genetically modified foods and their cross-border movement in EAEU countries as well as the measures of improving their customs' control.
