Автори висвітлюють специфіку втілення принципу свободи праці у правовому регулюванні дистанційної роботи науково-педагогічних працівників через приз-му досвіду України та Європейського Союзу. Вказується, що дистанційна робота науково-педагогічних працівників тісно пов’язана із принципом свободи волі в трудовому праві, адже трансформації, що відбуваються у вітчизняній системі освіти і у суспільстві в цілому передбачають здійснення трудової функції науково-педагогічними працівниками із систематичним застосуванням інформаційно-комунікаційних технологій. На переконання авторів, це вимагає відповідної трансформації у підходах до правового регулювання трудо-вих відносинах стосовно врахування волевиявлення науково-педагогічних працівників при переведенні на дистанційну роботу. Автори підкреслюють, що у даній ситуації неврегульо-ваними вітчизняним законодавцем залишаються декілька напрямків. По-перше, у трудовому законодавстві та у законодавстві про освіту не визначається, яку частину робочого часу працівник має бути залученим до дистанційного навчання, щоб його можна було кваліфіку-вати в якості дистанційного працівника. По-друге, чинне українське трудове законодавство дозволяє роботодавцю у невиправдано широкому переліку випадків переводити на дистан-ційну роботу працівників без їх згоди. Для виправленнях окреслених прогалин пропонується у ст. 60-2 КЗпП України закріпити положення, що дистанційним вважається працівник, який працює поза робочих приміщень роботодавця із використанням інформаційно-комунікаційних технологій більше 70 % від загального місячного обсягу робочого часу. Вважаємо, що у ст. 60-2 КЗпП України необхідно відобразити положення, що переведення працівника на дистанційну роботу без його згоди можливе лише у випадку запровадження надзвичай-ного або воєнного стану.
