Перелік корупційних кримінальних правопорушень закріплено в примітці ст. 45 Кримінального кодексу України. При цьому більшість науковців звертають увагу на неузгодженість цього переліку із закріпленими у Законі України “Про запобігання корупції” поняттями “корупція” і “корупційне правопорушення”. Використання вичерпних переліків у текстах нормативно-правових актів слугує їх юридичній визначеності, однак ці переліки роблять відповідну норму негнучкою. Метою статті є встановлення доцільності закріплення у Кримінальному кодексі України (КК України) переліку корупційних кримінальних правопорушень і внесення пропозицій щодо вирішення існуючих проблем, обумовлених таким законодавчим прийомом. Визнання певного правопорушення корупційним залежно від формального закріплення його в певному переліку є доволі вразливим рішенням. Це дає можливість постійно змінювати такий перелік без переосмислення змісту та ознак ко-рупції, закріплених на законодавчому рівні. Крім того, таки й підхід відкриває можливості для волюнтаризму в законопроєктуванні та суттєво обмежує суддівський розсуд у кримінальному провадженні, зокрема унеможливлює врахування конкретних обставин кримінального правопорушення при оцінці його суспільної небезпечності. Практика застосування кримінального процесуального законодавства щодо викривачів корупції також засвідчує помилковість обраного підходу до визначення терміна “викривач”. З метою вирішення означених проблем автори пропонують закріпити у КК України поняття корупційного кримінального правопорушення як такого, що містить визначені законом ознаки корупції, уточнити поняття корупції в Законі України “Про запобігання корупції”, визначити в Кримінальному процесуальному кодексі України, що викривачем є особа, за заявою чи повідомленням якої розпочато досудове розслідування корупційного кримінального правопорушення.
