The article explores the problem of resolving a criminal-legal conflict (which involves a person who has committed a socially dangerous act) through reconciliation. The relevance of the research topic is due to the fact that the legal conflict requires a binding solution, as it affects the most important social values. The purpose of this article is to disclose the nature and importance of reconciliation as a way of resolving a criminal-legal conflict. The authors used an analysis method, a synthesis method, a logical method, a historical method, and a formal legal method to write this article. According to the results of the study, the authors concluded that the application of criminal liability for reconciliation of the perpetrator with the victim is effective for all parties to the criminal-legal conflict. Moreover, for the state as a party to the criminal-legal conflict, such a way of resolving, is also effective because of the fact that the achievement of the tasks of criminal responsibility with the minimum cost of resources is the restoration of the rights of the victim.
The article deals with the issue of considering the fact that a person has a criminal record on criminal offence connected with domestic violence as a part of the ‘systematic nature’ characteristic. It is stated that the ‘domestic violence’ is used in the expression of criminal offences connected to domestic violence not within the scope of Article 1261 of Criminal Code of Ukraine but the framework of Law of Ukraine ‘On prevention and combat against domestic violence’, thus the ‘systematic nature’ characteristic does not cover criminal offences connected to domestic violence. It is pointed out that criminal liability for a criminal offence connected to domestic violence has criminal- law consequences and thus shall be considered when assessing the ‘systematic nature’ as a characteristic of domestic violence under Art. 1261 of CC of Ukraine. The following rules of qualification of criminal offences connected to domestic violence are formulated: 1) if a person has a criminal record for a criminal offence connected to domestic violence then such offence shall be considered when assessing the ‘systematic nature’ as a characteristic of domestic violence under Art. 1261 of CC of Ukraine provided that the offence has not lost it criminal law consequences; 2) if a person a person has been prosecuted twice or more times for an administrative offence under Art. 1732 of Code of Administrative Offences of Ukraine and has committed a criminal offence connected to domestic violence then such offence shall be taken into account when assessing the ‘systematic nature’ as a characteristic of domestic violence under Art. 1261 of CC of Ukraine and in cases when sanction for such offence is greater than the sanction provided for in Art. 1261 of CC of Ukraine, such actions shall be qualified as cumulative criminal offence. It is concluded that there could be a number of such combinations but the key conclusion is that it is necessary to account for criminal record for a criminal offence connected to domestic violence provided that such offence has not lost its criminal-law consequences when assessing the ‘systematic nature’ as a characteristic of domestic violence under Art. 1261 of CC of Ukraine.

Стаття присвячена дослідженню особливостей кримінальної відповідальності за готування до кримінального правопорушення і за замах на кримінальне правопорушення відповідно до Закону України «Про внесення змін до деяких законодавчих актів України щодо спрощення досудового розслідування окремих категорій кримінальних правопорушень» від 22.11.2018 р.На основі аналізу вітчизняного законодавства та наукової літератури встановлено, що поділ кримінальних правопорушень на злочини та кримінальні проступки відбувся здебільшого на основі кримінально-процесуального критерію, шляхом вибіркового коректування санкцій під класифікацію кримінальних правопорушень, а не на основі таких критеріїв як: ступінь суспільної небезпеки та правові наслідки кримінально караного діяння для особи, суспільства і держави; практика застосування кримінального та адміністративного законодавства; міжнародний досвід захисту людини, суспільства і держави від злочинів та проступків.Також встановлено, що законодавець в одних випадках врахував знижений ступінь суспільної небезпеки кримінальних проступків щодо злочинів, так готування до кримінального проступку не тягне кримінальної відповідальності. в інших випадках прирівнює ці види кримінальних правопорушень, а саме замах на кримінальний проступок є кримінально караним та не враховано значно меншого ступеня суспільної небезпеки кримінальних проступків при призначенні покарання за замах на кримінальне правопорушення.Ключові слова: стадії кримінального правопорушення, готування до кримінального правопорушення, замах на кримінальне правопорушення.
In modern conditions of development of public relations complication of activity of law enforcement agencies is observed. This is due to new challenges in the law enforcement system, including the fight against high levels of the organization and the criminal professionalism of corrupt individuals. Because of this, it is challenging for operational units to identify specific facts of illegal actions with the help of operational and investigative measures. At the same time, the fight against crime by establishing high quantitative indicators of disclosure remains one of the principles of law enforcement in Ukraine, including sometimes deviating from those means established by law. Therefore, the problem of provoking bribery is relevant for scholars of the legislator and law enforcement. The object of the study is criminal liability for provoking bribery. The research methodology consists of such methods as the dialectical method, analytical method, historical method, method of analysis of legal documents, articles, and monographs, method of generalization, comparison, synthesis, and modeling method. The authors identified the features of such liability to clarify the problematic issues of qualification of provoking bribery, and to distinguish the distinctive features of prosecution from other types of crimes.
