This paper examines the relationship between banditry, robbery committed by an organized, armed group of people and extortion, and the main normative sources of domestic legislation. In addition, official statistics provided to the Prosecutor General's Office of Ukraine were examined to assess the prevalence and risk of banditry. The author analyzes the features of the corpus delicti, their qualifications, and problematic issues in the application of this knowledge in the practice of law enforcement and judicial authorities. The articles cover certain aspects of robbery, such as burglary and violence or the threat of intrusion. Particular attention is paid to the main features of the gang, namely: the number of subjects of the crime; stability; armament; the general purpose of the group members; way of committing a crime. Parallels were drawn between banditry and robbery, especially in terms of armaments, distribution of tasks between accomplices, their relationship, subordination and provision of a plan for further criminal activity. In distinguishing between robbery and extortion, a characteristic difference was established in the time limits of violence or the threat of its use: in robbery, they are aimed at taking possession of property immediately at the time of their use; in extortion: actions that involve violence or the threat of its use, aimed at obtaining property, as well as the requirement to transfer property, combined with the threat to use violence against the victim or his close relatives in the future. Also the actions which are offered for qualification in actions of the person of signs of investigated structures of crimes are defined. The types of damage caused to victims are analyzed. Based on the study, the author concludes that banditry, robbery and extortion are different in their criminal law nature of crimes, which have their own unique features and differ significantly in the objects of encroachment, the objective parties, somewhat coinciding only object composition and subjective side.
Domestic violence is one of the most common forms of human rights violations. Illegal actions against a family member are in most cases accompanied by acts of aggression, humiliation and abuse. Such actions by the abuser lead to a negative physical, mental and social health of the victim or several members of the family. As a rule, women, children and the elderly suffer the most from domestic violence. The state is the main actor in combating violence, and public authorities should help to create the environment of non-violence by taking the necessary measures and creating the system of protection of victims, punishment of perpetrators and prevention of violence. Despite the existing regulatory provision in the field of combating and protecting the rights and interests of victims of domestic violence, as well as a wide range of scientific papers focused on various aspects in this area, the problem of domestic violence remains relevant and needs theoretical clarification and justification. The purpose of the article is to determine the causes of the origin of domestic violence against the elderly, to analyze the forms for the commission of violence against persons of this category, to focus on the wide scale of this issue, preventive measures and the need to create an information base (statistics) of victims. The introduction of an information database (statistics accounting) of victims suffered from domestic violence will ensure unimpeded access for employees of the National Police, territorial centers of social services and medical institutions to information about the victims. Inquiries and reports will make it possible to quickly and efficiently update the information and keep differentiated statistical records of such persons.
The aim: To investigate the social danger of domestic violence, find out its principal manifestations, consequences, and impact on women and minors' health. Based on the acquired knowledge, to suggest ways to overcome this problem, which will minimize the consequences of domestic violence. Materials and methods: The authors studied and analyzed international legal acts, Ukraine's legislation, and scientific publications on domestic violence. The method of statistical processing of analytical data of the World Health Organization (hereinafter - WHO), the Institute of Demography and Social Research at the request of the UN Population Fund, the Ministry of Social Policy of Ukraine, the Ministry of Internal Affairs and the Prosecutor General's Office of Ukraine (for 2017 - first half of 2020) were used. A comparative method of research was useful in comparing the number of cases of domestic violence in Ukraine and Europe during the COVID-19 pandemic. Conclusion: It is concluded that domestic violence is a socially dangerous act that negatively affects all family members, as it causes significant damage to health and life. The most dangerous are the consequences of domestic violence on the physical and mental health of women and minors, who are particularly vulnerable to this negative manifestation. Rehabilitation is said to help minimize the effects of domestic violence, restore the physical and mental health of victims, and return them to normal social life.
У статті розглянуто питання щодо можливості прий няття закону про недопущення переслідування та покарання осіб у зв'язку з подіями, що мали місце в окремих районах Донецької та Луганської областей, що передбачено положеннями статті 6 Мінського протоколу. Проведено аналіз положень Кримінального кодексу Украї ни, Конституції Украї ни інших вітчизняних нормативно-правових актів. Розглянуто та проаналізовано ряд міжнародних правових актів у сфері міжнародного гуманітарного права. Виявлені недоліки та колізії в існую чих правових актах, що регулюють відносини в зазначеній сфері. Запропоновано низку варіантів вирішення таких проб лем. Запропоновано ряд змін, що потрібно внести до законодавства задля подолання колізій. Розглянуті можливі шляхи реалізації Мінського протоколу, не пов'язані із прий няттям окремого закону.Ключові слова: державна зрада, кримінальна відповідальність, мінські домовленості, Мінський протокол, тероризм, шпигунство, звільнення від кримінальної відповідальності, окремі райони Донецької та Луганської областей Украї ни.Постановка проб леми. У світлі збройного конфлікту на сході Украї ни, що триває більше п'яти років, а також з огляду на закріплення у Мінському протоколі положень щодо неприпустимості кримінального переслідування осіб, що стали учасниками цього конфлікту, актуальність обраної теми важко переоцінити [1].Аналіз останніх досліджень і публікацій. На жаль, на сьогодні існує небагато робіт, які спрямовані саме на розв'язання проб леми, пов'язаної з притягненням осіб до кримінальної відповідальності з огляду на положення «мінських домовленостей». На момент написання даної роботи, найбільш повно розкриває окремі аспекти даного питання стаття нау ковця Г. О. Усатого, що стала потужним підґрунтям для дослідження зазначеної теми [2].Крім цієї статті було взято до уваги роботи О. Ю. Борисова, П. А. Бурковського, І. Є. Смірнова, В. Кострова. Теми їхніх нау кових праць присвячені висвітленню проблем врегулювання конфлікту на Сході Украї ни, питань загрози Мінських домовленостей національним інте ресам Украї ни та можливостей реалізації мирного процесу за їх положеннями.
