Авторами досліджено принцип верховенства права як фундаментальну засаду галузі адміністративного права. Автори вказують, що верховенство права як фундаментальний принцип галузі адміністративного права означає, що органи публічної влади не можуть діяти свавільно й зобов’язані дотримуватися нормативних приписів, які формуватимуть чітке розуміння тих заходів, що мають застосовуватись у певних правовід-носинах і, відповідно, даватимуть змогу громадянам розраховувати на очікуваний результат у взаємовідносинах із органами публічної влади. Автори окреслюють, що верховенство права інтегрує в собі такі провідні засади галузі адміністративного права, як справедливість, пріоритет та повага прав людини, заборона свавілля, законність, розумність, юридична визначеність, прозорість. На переконання авторів, верховенство права передбачає можли-вість існування дискреційних повноважень органів публічної влади, які в одних випадках чітко окреслюють компетенції органу публічної влади щодо прийняття певного рішення, а в інших – надають свободу діяти на свій розсуд шляхом оцінки ситуації та здійснення правомірного вибору однієї із законних альтернатив. Автори вказують, що завдяки реалізації верховенства права як фундаментального принципу галузі адміністративного права має забезпечуватися високий рівень довіри громадян до діяльності органів публічної влади та їхніх рішень, що має сприяти позитивній трансформації взаємодії громадянського суспільства й держави.
