Авторами вивчаються проблеми забезпечення принципу свободи договорів про працю в умовах дистанційної роботи науково-педагогічних працівників. Дистанційна робота як перспективний напрям піднесення виробничої сфери та прискорення економічного тання, потребує ефективного та дотичного використання, щоб не завдавати шкоди здоров’ю працівників та не нівелювати їхні традиційні професійні якості. Для унеможливлення прояву зазначених ризиків дистанційна робота потребує належного правового регулювання. На думку авторів, розповсюдження нормативних положень про дистанційну роботу не лише на відповідних працівників інформаційно-цифрової сфери не відповідає як принципу єдності і диференціації правового регулювання трудових відносин, так і принципу свободи договорів про працю. Автори констатують, що відповідно до положень підзаконних нормативно- правових актів про здійснення дистанційного навчання та практики їх втілення у закладах вищої освіти первинна трудова функція науково-педагогічних працівників в умовах дистанційної роботи була заміщена функцією адміністрування мережевого освітнього процесу з максимальним витісненням викладацької і наукової складової. У такий спосіб здійснюється недопустимий із точки зору принципу свободи договорів про працю вплив на волю науково-педагогічних працівників, які позбавляються можливості повноцінно реалізовувати власну трудову функцію та погоджуватись на зміну умов трудового договору в процесі переходу на дистанційне навчання. Авторами пропонується перенести положення про дистанційну роботу в окрему главу Кодексу законів про працю України, норми якої будуть розповсюджуватись лише на тих працівників, в яких здійснення трудової функції, пов’язаної з ІТ-сферою, є провідною. Автори також пропонують розробити Наказ Міністерства освіти і науки України “Про службу дистанційного навчання в закладах вищої освіти”, який буде регулювати положення про роботу відповідної служби, до завдань якої має належати організація дистанційної роботи в закладах вищої освіти, контроль, а також складання звітності про її виконання.
Автори висвітлюють специфіку втілення принципу свободи праці у правовому регулюванні дистанційної роботи науково-педагогічних працівників через приз-му досвіду України та Європейського Союзу. Вказується, що дистанційна робота науково-педагогічних працівників тісно пов’язана із принципом свободи волі в трудовому праві, адже трансформації, що відбуваються у вітчизняній системі освіти і у суспільстві в цілому передбачають здійснення трудової функції науково-педагогічними працівниками із систематичним застосуванням інформаційно-комунікаційних технологій. На переконання авторів, це вимагає відповідної трансформації у підходах до правового регулювання трудо-вих відносинах стосовно врахування волевиявлення науково-педагогічних працівників при переведенні на дистанційну роботу. Автори підкреслюють, що у даній ситуації неврегульо-ваними вітчизняним законодавцем залишаються декілька напрямків. По-перше, у трудовому законодавстві та у законодавстві про освіту не визначається, яку частину робочого часу працівник має бути залученим до дистанційного навчання, щоб його можна було кваліфіку-вати в якості дистанційного працівника. По-друге, чинне українське трудове законодавство дозволяє роботодавцю у невиправдано широкому переліку випадків переводити на дистан-ційну роботу працівників без їх згоди. Для виправленнях окреслених прогалин пропонується у ст. 60-2 КЗпП України закріпити положення, що дистанційним вважається працівник, який працює поза робочих приміщень роботодавця із використанням інформаційно-комунікаційних технологій більше 70 % від загального місячного обсягу робочого часу. Вважаємо, що у ст. 60-2 КЗпП України необхідно відобразити положення, що переведення працівника на дистанційну роботу без його згоди можливе лише у випадку запровадження надзвичай-ного або воєнного стану.
