В статье рассматривается действие уголовно-процессуального закона в «киберпространстве». Анализируются основные теоретические подходы. Раскрываются недостатки международного правового регулирования. Предлагается рассматривать «киберпространство» с точки зрения режима общих международных территорий. Обосновываются условия допустимости производства трансграничных следственных действий. Аннотация. Статья посвящена детальному анализу новеллы уголовно-процессуального законодательства, определяющей порядок изъятия электронных носителей и копирования с них информации. В декабре 2018 г. Уголовно-процессуальный кодекс Российской Федерации был дополнен статьей 164 1 , установившей «особенности изъятия электронных носителей информации и копирования с них информации при производстве следственных действий». В настоящий момент запрещено изымать электронные носители информации при расследовании дел в сфере предпринимательской деятельности, за исключением установленных законом случаев. Следователю предоставлено право самостоятельно копировать информацию с электронных носителей. Требование об обязательном участии специалиста в изъятии электронного носителя информации законодатель оставил без изменения. Оценивая законодательные поправки, авторы обосновывают необходимость признания утратившим силу данного императивного требования.
