Метою статті є дослідження поважних причин у трудовому праві як соціально-правової категорії. Закладено теоретичні засади нового розуміння поважних причин: воно засновано на існуванні в трудовому праві поваги до носія здібності до праці – людини праці. Вони не можуть бути тільки елементом у механізмі притягнення працівників до дисциплінарної або матеріальної відповідальності. Обмежувати їх площиною негативного регулювання означає звужувати сутність відносин співробітництва суб’єктів праці, в якому повага до особи, її прав та законних інтересів має позитивне наповнення. Зроблено висновок, що правове регулювання поважних причин не обмежується застосуванням у законодавстві, бо ця категорія активно використовується в судовій практиці та в інших сферах правозастосування. Навіть правове регулювання поважних причин у трудовому праві не можна зводити до випадків прямого використання цього словосполучення в тексті законів і підзаконних актів, оскільки вони часто мають невичерпний перелік та розширюються роботодавцями й іншими суб’єктами правозастосування в межах їхніх повноважень. Розкрито новий аспект дії поважних причин, які в правозастосуванні знаходять продовження у втіленні принципів гуманізму і справедливості. Обґрунтовано пропозицію у майбутньому Трудовому кодексі закріпити фактичні підстави, що виключають відповідальність у трудовому праві, які у судовій практиці невиправдано змішуються з поважними причинами.
