Аннотация. В статье рассматривается проблема ограничения возможности членства иностранных граждан и лиц без гражданства, временно пребывающих на территории Российской Федерации, в российских профсоюзах. На основе исследования законодательства и практики его применения авторы отмечают, что защита прав работников профсоюзами призвана дополнить государственные механизмы защиты прав граждан и является факультативной. Реализация же интересов работников практически невозможна в отсутствие их действенного объединения, поэтому ограничения, которые установлены для временно пребывающих в России иностранных граждан и лиц без гражданства применительно к членству в профсоюзах, необходимо оценивать с точки зрения обеспечения их интересов в сфере труда. Объективным обоснованием запрета на вступление в российский профсоюз иностранного гражданина и лица без гражданства, временно пребывающего на территории России, выступает отсутствие у данных лиц длительной связи с Российской Федерацией, сиюминутный характер их интересов в сфере труда. Вместе с тем, учитывая возможность длительного осуществления трудовой деятельности на территории России, авторы предлагают признать право на вступление в профсоюз за иностранными гражданамиквалифицированными работниками, осуществляющими трудовую деятельность на основании разрешения на работу.
