Кримінальна протиправність неповнолітніх залишається непоборною силою протягом декількох століть, а наприкінці минулого ХХ століття відмічено її зростання. Кримінально-правові заходи протидії кримінальній протиправності неповнолітніх не є основними. Не можна не враховувати, що зростання кримінальної протиправності неповнолітніх відбувається в умовах інтенсивного соціального розшарування суспільства, суттєвого зниження життєвого рівня значної частини населення, несприятливого розвитку сімейно-шлюбних відносин, росту різних проявів жорстокого поводження з неповнолітніми. В такій обстановці першочергове значення мають соціальні, економічні та профілактичні заходи. Однак, коли кримінальне правопорушення вже вчинене, виникає питання про кримінальну відповідальність неповнолітнього. У кримінально-правових доктринах різних країн тривають пошуки оптимальних відповідей на питання про: особливості призначення та межі кримінальної відповідальності для різних вікових груп; вплив особливостей психіки дітей, її патологічних відхилень на призначення покарання; базові та спеціальні критерії обрання окремих видів покарання до неповнолітніх у законодавстві та правозастосовчій практиці; співвідношення призначення покарання із заходами ювенальної юстиції. Окремою проблемою є питання про те, на якому віковому етапі та рівні розвитку інтелекту і волі особа стає суб’єктом кримінально-правових відносин і може нести відповідальність за кримінальне правопорушення. У даній статті зроблено спробу проаналізувати особливості застосування покарань щодо неповнолітніх, окремі аспекти щодо фактів, які впливають на призначення покарання. Проведено аналіз Розділу XV Кримінального кодексу України та особливості його застосування на практиці. Зроблено висновок при застосуванні покарання до неповнолітнього суду слід застосовувати і норми Розділу XV Кримінального кодексу України.
Належний захист прав засуджених є однією зі складових умов вступу України до Європейського Союзу, оскільки проблема реалізації, охорони та захисту прав людини в місцях позбавлення волі постає як одне з найважливіших завдань для кожної демократичної держави. Прагненням держави відповідати європейським стандартам, зокрема, стала ратифікація Конвенції про захист прав людини та основних свобод, яка передбачає, зокрема і захист прав та поваги до людської гідності до осіб, які відбувають покарання за вчиненні правопорушення. Охорона та захист прав як громадян, так і засуджених осіб до позбавлення волі в Україні, потребують якісного правового забезпечення та застосування його в практичній діяльності, що зумовлює необхідність наукового аналізу захисту прав засуджених Як свідчить генезис дослідження, Україна та Республіка Польща здійснили чимало зусиль у міжнародному правовому полі при переході від тоталітарного до демократичного режиму для приведення свого законодавства до відповідності та гармонізації з Європейськими нормами, стандартами ООН щодо захисту прав та свобод людини і громадянина. Статтю присвячено порівняльній характеристиці захисту прав засуджених в Україні та Республіці Польща, дослідженню нормативно-правової бази захисту прав засуджених вітчизняного та міжнародного рівня, аналізу загальних та основоположних прав засуджених, що визначені Конвенцією про захист прав людини та основних свобод Кримінально-виконавчим кодексом України та Кримінальним кодексом Республіки Польща. Встановлено спільні та відмінні риси захисту прав осіб, що зазнали покарання за вчинення кримінального правопорушення, зокрема тих, що перебувають у місцях позбавлення волі. Проведено аналіз правого статусу засуджених в Україні та в Республіці Польща. Досліджено особливості забезпечення прав засуджених в умовах воєнного стану на території України.
