The urgency of the issue studied is stipulated by the need to understand the state of human rights in health care implementation through an analysis of the practice of the European Court of Human Rights The purpose of the study is to clarify understanding of the content of human rights in the field of health care by the European Court of Human Rights (following the Court's practice on Articles 2 and 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms) and to identify ways of improving these rights. The main approach to research on the issue of human rights protection in the field of health care is to systematically analyze the practice of the European Court of Human Rights. The expediency of adopting a separate protocol to Convention for the Protection of Human Rights and Fundamental Freedoms, the subject matter of which will be human rights in the field of health care, which can be an effective means of protecting human rights in the field of health care, is indicated.
Абстрактний характер приписів законодавства зумовлює необхідність використовувати дискрецію. Правильне застосування адміністративного розсуду є фактором забезпечення людських прав; неправильне застосування дискреції може бути розцінено як свавілля органів публічної влади, що і визначає актуальність теми дослідження. Участь України в євроінтеграційних процесах є додатковим фактором посилення актуальності пізнання проблеми адміністративного розсуду. Мета дослідження висвітлити вимоги до адміністративного розсуду в Україні та державах Європейського Союзу. Наголошується, що в умовах необхідності постійного вдосконалення діяльності органів публічного адміністрування задля найкращого забезпечення людських прав проблематика різних аспектів діяльності адміністративних органів (зокрема, застосування адміністративного розсуду) набуває перманентного характеру. Зазначається, що для національної системи права адміністративний розсуд є відносно новим правовим інститутом. Під час перебування у складі радянської держави цю тематику фактично не висвітлювала тогочасна юриспруденція, були відсутні фундаментальні дослідження цього правового інституту. Аналізується нормативне закріплення адміністративного розсуду в німецькому законодавстві (Законі про адміністративні процедури), а також у межах Ради Європи (Рекомендації Комітету Міністрів Ради Європи щодо здійснення дискреційних повноважень органами адміністративної влади). Резюмується, що одним із напрямів подальшого вдосконалення діяльності вітчизняних адміністративних органів є зміна підходів до розуміння адміністративного розсуду, що дозволить посилити ефективність роботи органів публічної влади. При цьому за основу інтерпретації дискреції доцільно взяти сформований у межах держав Європейського Союзу концепт цього інституту права. Обґрунтовується, що адміністративний розсуд є тим засобом, що забезпечує ефективне виконання покладених на органи публічної влади повноважень; це спосіб виконання покладених на органи публічного адміністрування завдань із реалізації людських прав. Тому використання дискреції не може посягати на мету повноважень. Як подальший напрям наукових досліджень проблем адміністративного розсуду вказується відхід від догматичних аспектів сприйняття дискреції та зосередження уваги на практичних аспектах її реалізації.
The lack of a unified approach to understanding and tackling medical errors is a factor in the failure of the established leading legal practices of national courts. Under the Article 140 of the Criminal Code of Ukraine there exists a responsibility for improper performance of professional duties by a medical or pharmaceutical worker. Ukrainian law does not actually distinguish between a medical error and a criminal offense. Our results allow us to distinguish three approaches to understanding of the medical error. Under the first approach, a medical error is seen as objectively unlawful action with a negative social consequence inherent in it, a defect in professional activity. According to the second approach, a medical error is understood both as a result of good faith deceit and as a result of the committed negligence. In accordance with the third oneunder the error is recognized any departure from medical standards, including clinical protocols. The relationship between concepts "doctor's error", "medical error", "healthcare mistake" is determined. In the practice of the European Court of Human Rights, a medical error, medical negligence and deliberate failure or improper performance of professional duties are distinguished. The European Court of Human Rights sets out two aspects of dealing with cases of death due to failure of provision or inadequate provision of medical care: effective legal regulation of healthcare; efficient means of control, investigation and prosecution of perpetrators.

Акцентовано увагу на неправильності висновку щодо зв'язку виникнення терміна «правова система» з іменем французького правознавця Рене Давида. Зроблено висновок, що зарубіжні правники переважно уникають використання слова «legal system», а використовуючи, фактично ототожнюють явище, що ним позначається, з іншимпозначуване терміном «право». Європейська фахова правнича література не використовує терміни «Legal System» і «System of Law» як відповідники понять «правова система» і «система права».
