В наши дни искусственный интеллект становится предметом пристального внимания и обсуждения в научно-технической среде, со стороны журналистов, политиков, бизнесменов и широкой общественности. Данная ситуация требует реакции представителей социального знания. Однако социальные ученые не спешат выходить на поле исследований искусственного интеллекта: это характерно для мировой науки в целом, и Россия не является здесь исключением. Таким образом, перед современной социальной аналитикой стоит задача прояснения теоретико-методологических оснований исследования искусственного интеллекта. Настоящая статья ставит цель внести вклад в решение именно этой проблемы. Авторы начинают с обсуждения теоретико-методологических затруднений, которые определяются в терминах проведения концептуального различения между искусственным интеллектом как феноменом, проблемой и понятием. Затем формулируются определения трех ключевых понятий: «искусственный интеллект», «онлайн-культура», «искусственная социальность»; авторы приглашают научное сообщество к дальнейшей дискуссии. В завершении статьи обсуждаются возможность перехода от абстрактных рассуждений к эмпирическим затруднениям и перспективы исследований искусственного интеллекта и искусственной социальности. DOI: 10.17323/1811-038X-2020-29-2-49-71 Цель настоящей статьи состоит в предложении концептуальных инструментов для исследования скрытых (не вынесенных в публичное пространство) причин недовольства студентов вузов различными аспектами получаемого образования и в применении этих инструментов при анализе конкретных эмпирических кейсов. Рассмотрение скрытого недовольства студентов принципиально важно в контексте проникновения в практику управления вузами парадигмы академического капитализма, в рамках которой постулируется, с одной стороны, ориентация на нужды студента, с другой стороны, необходимость связи получаемого образования с требованиями современного рынка труда. Эмпирическим материалом для анализа выступают интервью и фокус-группы со студентами и преподавателями трех крупных вузов России и Украины, специализирующимися по социально-гуманитарным и техническим направлениям. В качестве основной теоретической базы были избраны положения французской прагматической социологии, в рамках которой университет рассматривается как организация, конституированная моральными конвенциями между ее членами. Сравнительный анализ позволил выделить ценностные основания критических аргументов, высказываемых студентами относительно получаемого образования: в ситуациях недовольства студенты, как правило, апеллируют к миру ценностей индустриального града справедливости (в терминологии Л. Болтански и Л. Тевено). На основании собранных данных мы выделяем два «идеальных» типа скрытого студенческого недовольства, принимающего сходные формы, однако сильно различающиеся по своей внутренней логике в зависимости от специальности. Представленные «идеальные» типы могут быть использованы в качестве оснований для гипотез в исследованиях российского (и шире – постсоветского) высшего образования.
Objective: the paper aims to define the problems juridical theory and practice face with the progress of AI technologies in everyday life and correlate these problems with the human-centered approach to exploring artificial intelligence (Human-Centered AI).Methods: the research critically analyzes the relevant literature from various disciplines: jurisprudence, sociology, philosophy, and computer sciences.Results: the article articulates the prospects and problems the legal system confronts with the advancement of digital technologies in general and the tools of AI specifically. The identified problems are correlated with the provisions of the human-centered approach to AI. The authors acknowledge the necessity for AI inventors, as well as the owners of companies participating in the race to develop artificial intelligence technologies, to place humans, not machines, into the focus of attention as a primary value. In particular, special effort should be directed towards collecting and analyzing high-quality data for the organization of artificial intelligence tools development, taking into account that nowadays, the tools of AI are as practical as the data on which they are trained are effective.The authors formulate three principles of human-centered AI for the legal sphere: 1) a human as a necessary link in the chain of making and executing legal decisions; 2) the need to regulate artificial intelligence at the international law level; 3) formulating “a taboo” for introducing the artificial intelligence technologies.Scientific novelty: the article manifests one of the first attempts in the Russianlanguage scientific literature to outline the prospects of developing humancentered AI methodology in jurisprudence. Based on an analysis of special literature, the authors formulate three principles of including artificial intelligence into juridical theory and practice according to the assumptions of a human-centered approach to AI.Practical significance: the principles and arguments the article advances can be helpful in the legal regulation of artificial intelligence technologies and their harmonious inclusion into legal practices.
