Multidisipliner bir alan olan adli bilimler, adaletin toplum ve toplumu oluşturan bireyler arasında eşit olarak sağlanabilirliğine hizmet eden sağlık, fen ve sosyal bilimler gibi eğitsel, teknolojik ve pozitif bilimler topluluğunu kapsar. Bu bilimsel alanda teorik ve uygulamanın birbirleriyle örtüşen ve örtüşmeyen birçok noktası bulunmaktadır. Teorik bilgilerin havada uçuştuğu çağımızda bu bilgilerin adli bilimlerin uygulama alanına yansıması çok önemlidir. Adli tıp, hukuk, psikoloji, sosyal hizmet, çocuk gelişimi, kriminoloji, antropoloji, öğretmenlik, medya, polis ve jandarma gibi güvenlik birimlerini de içeren toplumun çok geniş bir alanında birlikte çalışmaya ve üretmeye gereksinim bulunuyor. Eğitim ve öğretimin en önemli parçasını deneyimlerimiz ve uygulama alanları yani “olgu temelli” yaklaşım belirliyor.
Kafa bölgesine yönelik ateşli silah yaralanmaları sonucunda genellikle kafatası kemiklerinde kırık, beyin kanaması ve beyin doku hasarı meydana gelmektedir. Türk Ceza Kanunu’na (TCK) göre her biri tek başına yaşamsal tehlikeye neden olan bu üç yaralanma genelde birlikte bulunur.
Bilindiği üzere orbitada kraniumla iştirakli; süperior ve inferior orbital fissür ve de optik sinirin geçtiği optik kanal olmak üzere 3 esas foramen vardır.
Sunulan olguda, ateşli silah çeşitlerinden biri olan pompalı tüfekle yüz bölgesinden yaralanan ve bir adet saçma tanesinin orbita çukurunu kemik kırığı olmaksızın geçerek herhangi bir nörolojik semptom oluşturmaksızın beyin dokusunda kalan 39 yaşında bir kadın olgu sunulmuştur.
Olgu, saçma tanesinin orbita çukurundan kemik kırığına neden olmadan ilerleyerek beyin dokusuna isabet etmesine rağmen nörolojik bir semptom oluşturmaması fakat yaralanmanın vasıf olarak yaşamsal tehlikeye neden olan kriterler arasında olması açısından ilginç bulunmuş ve tehlike kriterini travmanın sadece lokasyonuna göre mi yoksa oluşturduğu hasara göre mi verilmesi gerektiği konusunu tartışmaya açmak amacı ile sunulmuştur.
Öz Darp sonucu maksillofasiyal travma meydana gelen ve adli rapor düzenlenmesi için Gaziantep Üniversitesi Adli Tıp Anabilim Dalına başvuran olgu, vaka sunumu olarak değerlendirilmiştir. 49 yaşında erkek hasta, darp neticesinde yüz bölgesinden yaralanmış, götürüldüğü sağlık kuruluşunda mandibulada fraktürü saptanması üzerine opere edilmiş, takip eden süreçte hastada bazı sekeller kalmıştır. Hastanın son durum muayenesinde yaklaşık 15kg kilo kaybı, ağız açıklığında azalma, maloklüzyon ve class II anterior openbite tespit edilmiştir. Darp-cebir ve kaza olgularında travmaya sıklıkla maruz kalan yüz bölgesinde gündelik işlevlerimizi ziyadesiyle ilgilendiren organlar bulunmaktadır. Halihazırda kullanılmakta olan "Türk Ceza Kanununa Göre Yaralanmalar" kılavuzunda maksillofasiyal travmalarda duyu-organ zayıflaması veya yitirilmesi açısından kullanılabilecek kıstaslar bulunmaması nedeniyle; bu hususta adli tıbbi yaklaşımın nasıl olması gerektiği konusunu tartışmaya açmak amacı ile bu olgu sunulmuştur.
Bilgiye erişimin kolaylaşması bilginin kötüye kullanımına yol açabilmektedir. Bu vaka sunumu ile adli mercilere başvuran olguların internet ortamından sözde deliller bulunarak bu makamları aldatmaya çalışabileceğine dikkat çekilmesi amaçlanmıştır. Darp-cebir sonucu çocuğunu düşürdüğünü iddia eden ve bunun için internet ortamından bulduğunu saptadığımız resimleri kanıt olarak göstermek suretiyle adli mercilere başvuran bir olgu sunulmuştur. Adli tahkikat dosyasının incelenmesi, öykü ve deliller arasındaki tutarlılığın değerlendirilmesi, şüphe halinde dosyada mevcut delillerin gerçekliğinin araştırılması önem arz etmektedir. Bu bağlamda internet ortamından elde edilebilen bir takım materyallerin sahte delil olarak dava dosyalarına girebileceğinin altını çizmek istiyoruz.
