The article analyzes public-private partnership (PPP) as a form of interaction between state and business in the context of optimizing the Ukrainian economy. According to the results of SWOT analysis of the implementation of PPP projects in the infrastructure of Ukraine (2017–2019), the main criteria that determine the necessary model of public-private partnership were substaintiated, namely the distribution of investments, risks, obligations between the state and the private sector, the term and object of the agreement.The study analyzed the impact of economic, political, legislative and criminal processes on public-private partnerships in Ukraine. It was proved that the formation of specific allocation relations based on the interaction between public and private property is the most important feature of public-private partnership, which distinguishes it from other forms of interaction between the state and business. Advantages of PPP are as follows: the increase of management efficiency of state and municipal property objects, the reduction of tax burden on the state budget and optimization of budget expenditures on public services provision, the maintenance of budget-funded institutions, etc. It has been established that the PPP is the best alternative to privatization in order to attract private investment in strategic infrastructure facilities.
В цивілізованому, демократичному суспільстві визначним є верховенство права. Саме тому, на шляху України до європейської спільноти необхідним є не лише модернізація політичних та економічних засад державної політики, подолання технологічної відсталості, розробка та реалізація новітніх технологій, створення нових робочих місць, тощо, а й реформування та вдосконалення методів боротьби із кримінальними правопорушеннями, що посягають на права громадян. Кримінальні правопорушення, пов’язані із домашнім насильством мають широкий резонанс не лише у зв’язку із небезпекою, яку воно несе життю та здоров’ю осіб, що стають учасниками таких подій, а й у зв’язку із тим, що вони наносять шкоду здоровому розвитку дітей та підлітків, перешкоджають формуванню сімейних цінностей в суспільстві. Збільшення вчинення таких кримінальних правопорушень негативно впливає на соціальний розвиток країни та на забезпечення різноманітних гуманітарних потреб населення. Подоланню такого суспільно небезпечного явища як насильство в загальному розумінні та домашнє насильство зокрема, сприяє модернізація та вдосконалення процесу розслідування кримінальних правопорушень, пов’язаних із ним. На сьогодні потребують вдосконалення механізми реагування державних інституцій на прояви домашнього насильства, процес притягнення винуватців до відповідальності, зокрема кримінальної, та відповідно вдосконалення процесу судового розгляду відповідних проваджень. Така діяльність, в свою чергу, передбачає розробку нових методик із розслідування кримінальних правопорушень, пов’язаних із домашнім насильством, які повинні враховувати все різноманіття способів його вчинення та приховування, мотиви вчинення насильницьких дій, місця та механізм вчинення протиправних діянь, тобто всі криміналістичні та кримінально-правові характеристики кримінального правопорушення. Визначальними для створення ефективної методики розслідування кримінальних правопорушень, пов’язаних із домашнім насильством є пізнання процесів, що відбуваються під час вчинення зазначених кримінальних правопорушень, визначення причинно-наслідкових зав’язків між учасниками події, виокремлення закономірностей відображення такої діяльності у матеріальному середовищі, узагальнення та систематизація особистісних характеристик як кривдника так і жертви.
Analysis of scientific research and publications, study of materials for monitoring the state of regulatory response to and response to domestic violence, materials of investigative and judicial practice, suggests that the issue of timely and effective investigation of domestic violence and criminal offenses related to them, is becoming increasingly important. The purpose of the article is to determine the conditions for the formation of psychological behavioral characteristics of victims of domestic violence, understanding of which helps to establish cause-and-effect relationships and investigators choose tactics of obtaining forensic information during pre-trial investigation of criminal offenses related to domestic violence. The methodological basis of the article is general scientific methods of cognition such as analysis, synthesis, deduction and modeling, which in turn allows to determine the cause-and-effect relationships, the reasons for their occurrence. The use of the induction method allowed to establish the repetitive nature of events, special legal method -the description of legal phenomena, substantiation of the legality of the behavior of the offenders and grouping patterns of behavior of the victim. Research results.The study analyzed the psychological characteristics of the victim in criminal offenses related to domestic violence, which became the basis for determining the forensic classification of this type of criminal offense. The scientific novelty is that the article analyzes the psychological and forensic characteristics of the victim in criminal offenses related to domestic violence and proposes, based on this analysis, a forensic classification of criminal offenses in this category. Conclusion. The practical significance of the article is that the generalization of the behavioral characteristics of the victim of domestic violence allows for a forensic classification, which will serve as a basis for choosing the algorithm of the investigator's actions to obtain verbal information during the pre-trial investigation.
