La desigualdad en el ingreso y la persistencia de altos grados de pobreza en gran parte de la población del mundo hacen relevante la pregunta por la justicia en relación con la función redistributiva del Estado. Esta es una de las razones importantes por las que los Estados han recurrido al aumento del cobro de impuestos como forma privilegiada de la obtención de recursos para lograr sus tareas sociales. El derecho tributario se ha convertido, de esta manera, en un eje de reflexión que interesa también a la crítica filosófica. En este horizonte problemático la pregunta central de este artículo de investigación será: ¿Qué aportes se han realizado desde las teorías de la justicia distributiva a la política tributaria de los últimos años, a la luz de la teoría aristotélica sobre justicia distributiva y de las concepciones en torno a los tributos en el marco de las teorías contemporáneas de la justicia de J. Rawls y R. Dworkin?
La democracia significa el autogobierno del pueblo por el pueblo y esto, fundamentalmente, a nivel local, por cuanto en este espacio de coordinación de la vida social se presupone de manera privilegiada que las instituciones político-administrativas están realmente gobernadas por la base popular o por sus representantes. De igual forma, las relaciones democráticas dependen de la fortaleza de las instituciones y del grado de confianza de los ciudadanos en ellas y en el proceso político. Esto último, a su vez, depende del grado de efectividad de las garantías reales que tenga la población a nivel micro para el ejercicio de la participación. Sin embargo, un asunto vital para la vida democrática consiste en la forma como la comunidad se apropia de esos mecanismos formales para construir sus propias condiciones de vida buena, y de generar los espacios necesarios para la construcción de valores y bienes comunes por fuera de los constreñimientos del mercado desenfrenado, generador de pobreza, desigualdad y exclusión. En este sentido, este artículo trata de establecer el marco normativo de la participación política en Colombia a nivel nacional y local, para señalar los límites y posibilidades de su efectiva realización en Bucaramanga.
