Die Strafrechtspflege stand seit der »Entdeckung« des Unbewußten unter starker Kritik durch die Psychoanalyse, die die Freiheit des Willens als Voraussetzung der Strafe ablehnte und bei der Erklärung des Verbrechens auf determinierende »unbewußte Motive« abstellte. Zu den Kritikern gehörte auch der 1882 in Würzburg geborene Autor Leonhard Frank, der stark von dem Analytiker Otto Groß beeinflußt war. In seiner 1915 veröffentlichten Erzählung »Die Ursache« schildert er den Mord an einem ehemaligen Volksschullehrer und den anschließenden Prozeß, der mit dem Todesurteil endet.
Wolfgang Schild – Professor für Strafrecht, Rechtsphilosophie und Strafrechtsgeschichte – legt hier eine sorgfältige Interpretation der »Novelle« vor. Dabei analysiert er zum einen das von Frank vertretene Konzept der Psychoanalyse und konfrontiert es mit der Theorie Freuds.
Zum anderen setzt sich Schild mit der psychoanalytischen Kritik auseinander und versucht, eine differenzierte Antwort aus Sicht der heutigen Strafrechtstheorie zu geben.
