The cursus honorum is a Latin phrase which translates to “course of honour”. It refers to the sequential order of public offices that were held by aspiring politicians in the Roman Republic and Empire. It was the Roman idea about the order of public offices which were held by citizens. One of the requirements for taking office was the age of the candidate to hold it. Over the centuries, Roman law changed the age limits required to take up a specific office. Starting from republican times, there were regulations in Rome that required candidates for office to reach a certain age. The aim of this paper is to present the importance of the age criterion for holding offices in ancient Rome. For this purpose, the available source texts were analysed and the existing literature on the subject was examined and presented. The research used the historical method, which includes the analysis of source texts, and the dogmatic and empirical research method, which includes the critical analysis of legal sources and literature on the subject. Thanks to the research conducted, the available sources and literature on the age limits used in the cursus honorum were discovered and unified. As a result of the conducted research, the results were presented, which made it possible to identify the age limits required for a civil servant career in ancient Rome. Research in this area is of theoretical importance. Secondly, such an analysis is important for further comparative legal research. In modern legal systems, each country sets certain age requirements for participation in public life in the broadest sense (e.g., the age at which one may vote or run for office). Thanks to the ongoing research on Roman law, it will be possible to make comparative analyses and thus search for the Roman sources of contemporary laws. In this part, the research has a practical (comparative law) meaning.
Sąd Najwyższy Stanów Zjednoczonych Ameryki w swoich opiniach niejednokrotnie odwoływał się do prawa rzymskiego. Czynił to przy okazji uzasadniania swoich orzeczeń. W zdecydowanej większości przypadków Sąd Najwyższy odwoływał się do prawa rzymskiego w kontekście historycznym tj. przy okazji wyjaśniania danego zagadnienia, w formie niejako dydaktycznej prezentował podstawę historyczną danej instytucji prawnej, najczęściej wywodząc ją od starożytności. Tym sposobem sędzia przygotowujący uzasadnienie starał się zaakcentować, że wydane orzeczenie poprzedzało wnikliwe, wielowątkowe badanie, które sięgało aż do źródeł danej instytucji prawnej. Jeżeli zaś chodzi o sposób w jaki Sąd Najwyższy sięgał po prawo rzymskie to czynił to w różnych formach. Najczęściej cytował konkretne źródła bądź w całości przytaczając łaciński tekst, bądź wskazując jedynie źródło. Wśród cytowanych fragmentów znajdowały się Instytucje Gaiusa, Instytucje Justyniana, Kodeks oraz Digesta, rzadziej Sąd sięgał do Kodeksu Teodozjańskiego. In every legal system, regardless of whether we mean antique or modern law, there have always been and there are regulations that have specific effects depending on the age of a given person. Such regulations are known in all contemporary legal systems of the world in every branch of law. In the presented article the author has elaborated the influence of human age on persons' trade rights in ancient rome. Consequently it has occurred that in roman law there were two age limits which played a significant role in commerce. The first one was the age of 14 years when a boy got full legal capacity, and the second one was the age of 25 years when he was becoming fully independent from any restrictions and special protection. Badania pokazują, że w prawie rzymskim istniały dwie granice wiekowe, który odgrywały znaczoną rolę w handlu. Pierwszą z nich była granica 14 lat, która wyznaczała moment osiągnięcia przez mężczyznę pełnej zdolności do czynności prawnych, zaś drugą była granica 25 lat, kiedy to osoba stawała się w pełni niezależna i wychodziła spod ograniczeń prawnych i specjalnej ochrony.
The public prosecutor’s office is one of the most important state organs responsible for upholding the rule of law and prosecuting crimes. The efficient functioning of the office is one of the guarantees of the implementation of a democratic state ruled by law. After 1989, in the countries of Central and Eastern Europe, after independence from Soviet influence, the prosecution authorities began to reform, trying to adapt to the new conditions. The exchange of mutual experiences in this area has a special form in the case of Poland, Hungary, Slovakia and the Czech Republic, i.e. the countries making up the so-called Visegrad Group, within which the prosecutors general meet each year to deepen cooperation. The purpose of this article is to present the principles of the functioning of the prosecutor’s office in the V4 countries and to compare them also from a historical perspective.
The age of a human being is a common research topic in many branches. This topic is also addressed by the legal theory. Age categories also functioned in Roman law, determining the legal position of a person. In this article, the non-judicial sources which concerned the division of human life are analyzed. Consequently, it has been possible to determine that in ancient Rome, there were several theories concerning this matter. The division of life into three, four, five, six or seven stages was very popular. Each theory has different justifications and various arguments. Among those, we can distinguish medical, psychological, numerical and also military-administrative arguments.
