This study aims to further examine the implementation of individual candidate reviews in the mayoral election in Surakarta City in 2020. The city of Surakarta implemented direct elections in 2020 which were followed by political parties, in this case PDI Perjuangan (Gibran Rakabuming Raka and the individual Teguh Prakoso). ) and individual candidate Bagyo Suparjo who will appear in the direct election according to the decision of the Pilwalkot participants.This study uses a normative legal research method using a statutory approach (Statute Approach) and a case approach (Case Approach). The approach in normative research examines data that is directly taken from a literature review and secondary data that can be studied through document studies is found at the Surakarta City Regional General Election Commission. This is in accordance with the 1945 Constitution and Law no. 10 of 2016. This approach is expected to get an overview of normative studies using descriptive analysis and purposive sampling.The results of the temporary study showed that the implementation of the individual candidate review in the mayoral election in the city of Surakarta was won by Gibran Rakabuming Raka and Teguh Prakoso who defeated Bagyo Suparjo. The existence of individual candidates in the political and democratic system occurs because Law Number 32 of 2004 concerning Regional Government only limits and facilitates candidates for regional heads who come from political parties only. Individual candidates in the post-conflict local elections in Indonesia are not significant because one of the regulations governing individual candidates is burdensome to individual candidates, even though individual candidates have been regulated in the 1945 Constitution and strengthened by the Constitutional Court Decision Number 5/PUU-V/2007 which is the political right of the people to vote. Chosenas a form of democracy and human rights. Deparpolization is caused by the decline in public confidence in political parties so that people look for other political routes and provide space for people who do not have political vehicles, which are expected to be able to answer the deadlock of political parties so that their political rights can run well.
Tujuan Penelitian. Ingin mengkaji dan menganalisis kebijakan progresif dalam pelaksanaan PP No. 24 tahun 1997 terhadap pemberian sertifikat sebagai alas hak yang sah dan mengkaji dan menganalisis faktor pendukung dan penghambat implementasi kebijakan progresif tersebut. Latar Belakang. Kebijakan Negara dalam menjalankan amanah PP No.24 Tahun 1997, Yakni melakukan proses pendaftaran tanah secara lengkap dengan menganulir hakekat konversi bidang pendaftaran tanah yang seharusnya dibeikan waktu 20 tahun dari UUPA No.5 Tahn 1960 sampai dengan Tahun 1980. Namun negara mempunyai otoritas mengambil kebijakan progresif dengan masih menerima terhadap pendaftaran tanah yang belum mempunyai alat bukti sertifikat.Hasil Penelitian. Pelaksanaan pendaftaran tanah sistem lengkap merupakan kebijakan progresif negara melalui PP 24 Tahun 1997 bahwa pemberian kepastian hukum terhadap hak atas tanah kepada masyarakat dilakukan dalam rangka tertib administrasi dan rasa nyaman atas alat bukti kepemilikan yang dipegang oleh pemilik tanah. Hal ini merupakan kebijakan negara walaupun aturan konversi bahwa sejak 24 September 1960 (UUPA) sampai dengan tahun 1980 telah dilakukan ketentuan konversi setiap pemilik hak atas tanah harus melakukan penyesuaian hak atas tanah yang tercantum dalam UUPA. Namun, sampai dengan saat ini negara masih memberlakukan proses pendaftaran tanah progresif (PTSL) sehingga dapat disimpulkan negara mempunyai kebijakan progresif yang dilakukan menurut PP 24 Tahun 1990. Faktor-faktor yang menjadi kendala dalam pelaksanaan PTSL di Kabupaten Boyolali, antara lain: a. Tingkat pendidikan masyarakat yang masih sangat rendah, menyebabkan tidak semua komponen masyarakat memahami dan memiliki daya tanggap yang cepat terkait pelaksanaan PTSL; b. Pemohon PTSL susah untuk dihadirkan pada saat kegiatan pengukuran karena adanya beberapa kesibukan. c. Pemohon tidak melakukan pemasangan tanda batas dengan beberapa alasan, baik itu karena belum ada waktu yang tepat ataupun masih terjadi sengketa dengan pemilik tanah yang berbatasan hal ini menyebabkan penundaan kegiatan pelaksanaan. d. Kelengkapan pengumpulan syarat administrasi oleh para pemohon.Kata kunci : kebijakan progresif, alat bukti sertifikat
The juvenile justice system for children in conflict with the law still takes into account the best interests of both the child without taking away the child's human rights and the child does not get negative stigmatization from the judicial process. The purpose of this study is to identify and analyze law enforcement efforts to diversify and correct understanding is expected to be used as input for law enforcers who handle juvenile cases, so that diversion is an alternative to imprisonment. This research was conducted to find legal principles in the concept of diversion and the concept of punishment, then used as a basis for assessing the requirements for diversion efforts and based on primary and secondary data. Diversion is the best solution for children, as an alternative in imposing criminal sanctions. The Law on the Criminal Justice System for Children requires diversion for every child, it can only be done if the penalty is under 7 years old. Children who are subject to diversion sanctions create responsibility towards other people (victims, victims' families, schools) and are obliged to take risks for their actions.
