Teknolojik gelişmeler, gündelik hayatı olduğu gibi çalışma hayatını da etkilemektedir. Bu gelişmeler, gerek yeni çalışma biçimleri gerekse de çalışma süreleri bakımından esnek modelleri hızla uygulamaya kazandırmaktadır. Mevcut hukuk kurallarının bu esnek modeller karşısındaki durumu, bir an evvel ele alınmalıdır. Bu doğrultuda Almanya'da ortaya çıkan ve yaygın olarak uygulanan esnek çalışma süresi modellerinin en ileri görünümü olan güvene dayalı çalışma süresi (Vertrauensarbeitszeit) bu çalışmanın konusu olarak seçilmiştir. Güvene dayalı çalışma süresinin Türk hukukunda geçerli olarak kararlaştırılıp kararlaştırılamayacağı incelenirken İsviçre hukukunda yapılan gerçek ve gerçek olmayan güvene dayalı çalışma süresi ayrımı esas alınmış, bunlar bakımından çalışma süresi kaydına ilişkin mevcut düzenlemelerin bir sınır teşkil edip etmeyeceği ve bu bağlamda ortaya çıkması muhtemel ispat hukuku sorunları üzerinde durulmuştur.
ÖzetNevşehir/Hacıbektaş ilçesinde kuyulardan alınan su örneklerinde, Ankara Refik Saydam Hıfzısıhha Merkezinde analizi neticesinde, sularda normalin üstünde nitrat olduğu anlaşılmıştır. İzleme çalışmaları kapsamında Yalnızağıl mevkiindeki 3 kuyudan alınan su numunelerinde 69.7 mg/L, 56.8 mg/L ve 59.4 mg/L oranlarında nitrata rastlanmıştır. Bu çalışmanın amacı, içme sularında yüksek düzeyde nitrat bulunan Akkaraman koyunlarında serum seruloplazmin, paraoksanaz ve nitrik oksit düzeylerindeki değişimleri araştırmaktır. Çalışmada bölgedeki Akkaraman koyunları materyal olarak kullanılmıştır. İçme sularında yüksek oranda nitrat bulunan koyunlardan kan örnekleri alınarak serum seruloplazmin, paraoksanaz ve nitrik oksit düzeyleri analiz edilmiştir. Serum seruloplazmin, paraoksanaz ve nitrik oksit düzeyleri spektrofotometrik olarak ölçülmüştür. Serum seruloplazmin, paraoksanaz ve nitrik oksit düzeyleri kontrol ve çalışma gruplarında sırasıyla 10.68±0.14 uM; 10.80±0.32 uM: 151.36±14.95 U/ml; 142.57±17.85 U/ml ve 2.01±0.30 U/ml; 0.99±0.11 U/ml bulunmuştur. Serum seruloplazmin düzeyleri çalışma grubunda kontrol grubuna göre istatiksel olarak önemli düzeyde düşük bulunmuştur. Serum paraoksanaz ve nitrik oksit düzeyleri gruplar arasında istatiksel önemli farklılık göstermemekle birlikte serum paraoksanaz düzeyleri çalışma grubunda daha düşük düzeylerde ölçülmüştür. Bu sonuçlar doğrultusunda, Akkaraman koyunlarda nitratın olumsuz etkilerinin mevcut konsantrasyonlarda meydana geldiği düşünülmektedir. Nitrate values of three well water sampling points in the province of Yalnızağıl obtained from the monitoring works 69.7 mg/L, 56.8 mg/L and 59.4 mg/L nitrate ratios were found. The purpose of this study is to investigate the changes of serum ceruloplasmin, paraoxonase and nitric oxide levels in Akkaraman sheep with high nitrate in drinking water. In this study, Akkaraman sheep which is the animal population of region were used as material. The blood samples collected from Akkaraman sheep were analyzed in terms of ceruloplasmin, paraoxonase and nitric oxide levels by spectrophotometry. Serum ceruloplasmin, paraoxonase and nitric oxide levels was found, 10.68±0.14 uM; 10.80±0.32 uM: 151.36±14.95 U/ml, 142.57±17.85 U/ml and 2.01±0.30 U/ml, 0.99±0.11 U/ml by means of control and study groups respectively. Statistically, Serum ceruloplasmin levels were significantly lower in the study group compared with control group. In addition, although paraoxanase and nitric oxide levels in serum were not show significant differences between groups, measurments reveal that paraoxanase levels were lower in study groups. These results suggest that adverse effects of nitrates on Akkaraman sheep occur at concentrations present in the fields.
On 29.01.2016, a couple of amendments were introduced to the 4857 Labor Law with the Law No. 6663. These amendments are related to the Article 13 and Article 74 of the Labor Law, which respectively regulate the part time labor agreement and working in maternity period and breast feeding permission. Following these changes, "Regulation on Part-time Work after Maternity Leave and Unpaid Leave" entered into force through publication in the Official Gazette dated 08.11.2016. New amendments in question are broadly about right to use unpaid leave for one-half of working hours and right to work part-time. Thus, regarding the maternity in addition to the right for maternity leave and right for unpaid leave up to six months, right for unpaid leave for one-half of their working hours for a period of sixty days for the first birth, one hundred and twenty days for the second birth, and one hundred and eighty days for any subsequent births and right for part-time employment until the period in which the child starts compulsory elementary education were ensured. It is necessary to investigate all the aspects of these changes legally, which are also highly important in terms of practice.Keywords: right to work part-time, right to unpaid leave for half of the working hours, part-time payment, maternity leave, parental leave. JEL Codes: J83, K31 DOĞUM SONRASI ÜCRETSİZ İZNE VE KISMİ SÜRELİ ÇALIŞMAYA İLİŞKİN YENİ DÜZENLEMELER ÖZET 29.01.2016 tarihinde 6663 sayılı kanun ile 4857 sayılı İş Kanunu'nun kısmi süreli iş sözleşmesini düzenleyen 13. maddesi ile analık halinde çalışma ve süt iznini düzenleyen 74. maddesinde değişiklikler yapılmıştır. Bu değişikliklerin ardından "Analık İzni ve Ücretsiz İzin Sonrası Yapılacak Kısmi Süreli Çalışmalar Hakkında Yönetmelik" de 08.11.2016 tarihli Resmi Gazetede yayımlanarak yürürlüğe girmiştir. Söz konusu yeni düzenlemeler genel olarak haftalık çalışma süresinin yarısı kadar ücretsiz izin hakkı ve kısmi süreli çalışma hakkına ilişkindir. Böylece mevzuatımıza, kadın işçiye analık durumu ile alakalı olarak daha önceden tanınmış olan analık izni ile devamında altı aya kadar ücretsiz izin hakkına ek olarak iki hak daha eklenmiş olup bunlar benzer yöndeki uluslararası düzenlemelere yaklaşılması bağlamında önemlidir. Yeni düzenlemede birinci doğumda altmış gün, ikinci doğumda yüz yirmi gün, sonraki doğumlarda ise yüz seksen gün süreyle haftalık çalışma süresinin yarısı kadar ücretsiz izin hakkı ve çocuğun ilköğretim çağının başladığı döneme kadarki kısmi süreli çalışma hakkına yer verilmiştir. Purpose -Turkish lawmaker adopted unemployment insurance with Law numbered 4447 in 1999. This study aims to scrutinize the conditions for benefitting from unemployment insurance, with the focus on the unemployment insurance payment. By studying on this, we want to bring some clarity to the practitioners. Methodology -The conditions for benefiting from unemployment insurance payment will be examined in the light of Court of Cassation's judgment and practice of Turkish Employment Agency in a comparative law approach. With this regard, we will refer to German Law which has a solid system of unemployment insurance. Findings -Unemployment benefit is granted only to unemployed insured whose employment contract is terminated on certain grounds and who has sufficient premiums. The requirements to be met for benefiting unemployment insurance are harsh, therefore they exclude majority of the unemployed persons. Conclusion-Although the scope of unemployment insurance has been extended recently, unemployment insurance alone is not sufficient to combat unemployment.
