Neste artigo apresento um contraste entre a possibilidade prática e moral de decisões judiciais contra legem de um lado e, do outro, de decisões judiciais baseadas em precedentes e superadas pelas técnicas do distinguishing e do overruling. Através da análise de caso cuja aplicação do precedente prevalece, e de exemplos reais e hipotéticos, meu objetivo é demonstrar que decisões contra legem propriamente entendidas implicam vereditos não só contrários a autoridade de precedentes em força, mas são desvios ao direito diversos das técnicas de superação dos precedentes já mencionadas. Desse modo, não apenas contrariam a literalidade de regras jurídicas, mas têm o potencial de razoavelmente contrariar a autoridade institucional do direito. Também sugiro que, se o contraste for correto e instancias de decisões contra legem forem moralmente permissíveis, será necessário discutir com maior cuidado o conjunto das obrigações que juízes têm sobre a aplicação do direito.
Objetivo: sugiro que a teoria das obrigações políticas associativas de Ronald Dworkin, conhecida por justificar a obediência moral ao direito pelos cidadãos, especialmente os juízes, está incorreta. Teorias associativas propõem que o vínculo constituído entre os indivíduos em práticas sociais é o fator responsável por justificar obrigações morais. Porém, vínculos associativos se mostrarão incompatíveis com o contexto sociopolítico, sobretudo, quanto ao papel exercido pelos juízes.Metodologia: apresento uma exposição crítico-reflexiva dos principais argumentos em favor e contra as obrigações associativas de Dworkin. A discussão teórica assume pressupostos da filosofia analítica, em que prossigo com uma análise normativa acerca desse tipo de obrigação.Resultados: procuro demonstrar como razões associativas que embasam a teoria em discussão são motivadas por relacionamentos sociais mais íntimos e parciais entre os indivíduos. Por isso, elas seriam incompatíveis com o tipo de obrigação moral e política esperado entre cidadãos e juízes.Contribuições: os argumentos abordados traçam quais são os limites e o escopo de teorias baseadas em obrigações associativas. Também permitem uma reflexão mais cuidadosa acerca da justificação normativa das obrigações políticas dos cidadãos e dos juízes.
Resumo: A obra política de John Locke foi um estudo de como se justifica a existência de um governo baseado na vontade geral, aspirando proteger os direitos naturais de liberdade, igualdade e propriedade. Acredita-se que todo esse pensamento se iniciou não apenas nos seus escritos políticos, mas em O Ensaio Acerca do Entendimento Humano. Tal obra retrata o modo pelo qual se adquire conhecimento, um aspecto fundamente que baseará as premissas da vontade geral e dos direitos naturais do homem nos seus escritos políticos. O Ensaio nem sempre é estudado em conjunto à literatura política de Locke, pois não existe consenso entre os estudiosos a respeito da unidade teórica entre o epistêmico e o político. Nesse sentido, procuro demonstrar que há uma congruência no pensamento de Locke, de modo que está presente um forte elo entre o Ensaio e, sobretudo, o Segundo Tratado Sobre o Governo Civil.
El libro Moral Combat: The Dilemma of Legal Perspectivalism, de Heidi Hurd, intenta determinar el ámbito de las obligaciones morales en la toma de decisiones judiciales, y llega a una conclusión escéptica sobre moralidades relacionadas con papeles. Continuaré esta discusión relacionando las tesis de Hurd con tres teorías conocidas sobre obligaciones de papales. En seguida, argumentaré qué papeles profesionales en sí mismos no pueden generar obligaciones morales. Y, finalmente, explicaré cómo otra teoría puede explicar mejor la relación entre papeles judiciales y obligaciones morales de una manera no constitutiva.
