Cet article s’inscrit dans le cadre d’une recherche sur l’accès à la justice des jeunes qui explore la participation des jeunes au système québécois de protection de la jeunesse. Face au manque d’attention de la communauté scientifique sur cette question, les auteures décidèrent d’organiser une table ronde interdisciplinaire pour discuter des défis, des expériences et des enseignements à partager entre les divers acteurs présents sur la scène de la protection de la jeunesse. L’article expose les principales pistes de réflexion émergeant de cette discussion, joignant les lacunes aux ouvertures pour améliorer l’accès des jeunes à la justice. La nécessité flagrante d’offrir des espaces de dialogue entre les différents professionnels du système, principalement les intervenants sociaux et judiciaires, se fait toujours plus pressante. Une approche collaborative, intersectionnelle et interdisciplinaire, non seulement centrée sur les jeunes mais également inclusive des jeunes, semble ainsi se dégager tant des échanges de la table ronde que des rares écrits portant sur le sujet.
Le droit a longtemps figuré comme le symbole de la certitude. Cette dernière constituait sa quête ultime ainsi que le maître-mot de sa construction et de son fonctionnement. Pourtant, à la faveur des approches dites post-modernes de la régulation sociojuridique, l’incertitude s’immisce progressivement dans l’univers juridique. S’il était un passage privilégié pour l’impulser, le droit des enfants ferait probablement office de favori. Ce champ juridique spécifique est en effet imprégné d’incertitude sous de nombreux aspects. Il appréhende des sujets singuliers, qui ne sont pas, selon leur âge, les individus libres et rationnels que le droit envisage traditionnellement et, qui plus est, qui traversent une période de transition sans pareille. Dès lors, nul ne se surprendra à trouver ici et là, dans les droits de l’enfant, de nombreuses traces d’incertitude, dont l’empreinte de la notion-phare du domaine, celle de l’intérêt de l’enfant, appuyée par sa forte flexibilité. Ce constat établi, cet article cherchera ensuite à explorer cette incertitude sous l’angle du principe de la participation des enfants aux décisions qui les concernent. Si l’on peut s’évertuer à combattre l’incertain en limitant l’effectivité de la participation, on pourrait également s’aventurer dans ce monde de l’incertitude, prendre le risque de s’y perdre, mais aussi et surtout, celui d’y trouver de nouvelles ouvertures pour les droits de l’enfant.
