Отсутствие целостного учения о закономерностях уголовного права не только образует пробел в познании его сущности, но в значительной мере обусловливает то критическое состояние, в котором пребывает современная российская уголовная политика. Для современного уголовно-правового регулирования характерны несистемность, спонтанность, спешность, избыточность, неадекватность запросам общества. Однако по сути уголовное право вовсе не хаотично, а имеет внутреннюю логику, социальную обусловленность, объективные и существенные связи, подчиняется определенным рациональным правилам, т. е. закономерно. Поэтому отсутствие в современном уголовном законотворчестве необходимого уровня системности, логичности и последовательности должно быть восполнено изучением закономерностей уголовного права. Данное исследование направлено на выявление закономерностей, характеризующих внутреннюю и внешнюю формы уголовного права. Для этого необходимо: проанализировать философское понятие «структура»; сформулировать понятие структурных закономерностей уголовного права; представить соотношение этого понятия с понятиями юридической техники; выявить и систематизировать структурные закономерности уголовного права. Методологической основой исследования выступили принципы объективности, всесторонности, всеобщей связи явлений, системности, а также общенаучные (анализ, синтез, индукция, дедукция, классификация) и частнонаучные (системно-структурный и формальнологический) методы. Автор приходит к выводам, что структурными выступают закономерности, выражающиеся во внутренней организации уголовного права, закона и уголовно-правовых явлений в качестве способа взаимосвязи элементов, составляющих их содержание; структурные закономерности уголовного права имеют сложный, многоуровневый характер.
