When examining the conclusions of expert examinations in a court session, it may be necessary to announce the testimony of an expert given by him at the stage of preliminary investigation. The author adheres to the point of view that does not exclude the announcement in court of the testimony of the expert, which he gave at the stage of preliminary investigation. There is no unambiguous answer to this question in the Code of Criminal Procedure of the Russian Federation. There is no uniformity in its decision in judicial practice and among scientists. Having considered this problem, the author justifies his vision of its solution.
