The article states that today in Ukraine the problem of criminal legal counteraction to collaborationism has finally received a proper legislative solution. The Verkhovna Rada of Ukraine has tried seven times to solve this problem in the relevant draft laws of Ukraine. And only the beginning of the open large-scale armed aggression of the Russian Federation against Ukraine prompted the Verkhovna Rada of Ukraine to implement one of these options to criminalize collaboration activities. The article considers Art. 111-1 of the Criminal Code of Ukraine, which on March 3, 2022 was provided by the Law of Ukraine «On Amendments to Certain Legislative Acts (on the Establishment of Criminal Liability for Collaborative Activities)». Based on the analysis of scientific literature and bills, certain conclusions were made about the construction peculiarities of the relevant components of collaboration activities. In particular, it was found that the vagueness of certain features of the relevant components of the criminal offense is contrary to the principle of legal certainty and requires further scientific research. Some forms of collaborationism need to be clarified or excluded. Such forms of committing a criminal offense primarily duplicate forms of treason. Such a form as «... actions of Ukrainian citizens aimed at implementing the educational standards of the aggressor state in such educational institutions» can be widely interpreted in judicial practice. It will lead either to selective justice or to the non-application of this form at all. It is stated that such ill-considered criminalization creates conditions for the rejection of the state by citizens who find themselves in difficult conditions in the occupied territories. Due to some similarities between treason and collaboration, the article identifies the possibility of avoiding traitors from severe punishment, as the punishment for most forms of collaborationism is milder than the punishment for treason. It is proposed to provide in the new part of Article 9. 111-1 of the Criminal Code of Ukraine incentive rule similar to Part 3 of Art. 111 of the Criminal Code of Ukraine. This is justified by the fact that the traitor can be released from criminal liability, and a less serious offense – collaborationism does not give the perpetrator such an opportunity. The authors of the article propose: to change the title of Section 1 of the Special Part of the Criminal Code of Ukraine to «Criminal Offenses Against the Foundations of National Security» and to provide in the sanctions of Parts 1 and 2 of Art. 111-1 of the Criminal Code of Ukraine alternative main punishment; to determine a citizen of Ukraine as a subject in all components of criminal offenses provided for in parts 1–7 of Art. 111-1 of the Criminal Code of Ukraine; to delete the reference to «voluntary cooperation» in parts 2, 5, 7 of Art. 111-1 of the Criminal Code of Ukraine; such forms of collaboration activities, which are provided for in part four of Art. 111-1 of the Criminal Code of Ukraine, to clarify by describing the specific consequences for national security. It is stated that the criminalization of collaborationism requires a comprehensive and systematic approach. First, a transitional justice strategy (concept) needs to be approved, which should, in particular, balance amnesty and prosecution of perpetrators. Secondly, the political component of the implementation of these legislative changes should be envisaged, as it does not exactly contribute to the peaceful settlement of the existing Russian-Ukrainian war.
У статті розглянуто окремі положення нормативно-правових актів, які регулюють участь цивільних осіб у захисті України. Здійснено класифікацію цивільних осіб, які беруть участь у захисті України, на такі види: 1) особи, які за наближення ворога добровільно взялися за зброю для того, щоб чинити опір військам, що вторглися; 2) особи, які на добровільній та конфіденційній основі співпрацюють із Силами спеціальних операцій Збройних сил; 3) члени добровольчих формувань територіальної громади. Установлено певні розбіжності у правовому забезпеченні вказаних категорій цивільних осіб, які беруть участь у захисті України. Місцем участі цивільних осіб у захисті Вітчизни визначена територія, яка підконтрольна Україні (для членів добровольчих формувань територіальної громади) і яка тимчасово окупована (для осіб, які чинять спротив ворогу на власний розсуд, та осіб, які на добровільній та конфіденційній основі співпрацюють із Силами спеціальних операцій Збройних сил; для членів добровольчих формувань територіальної громади). Проведене дослідження правового забезпечення участі цивільних осіб у захисті України засвідчило наявність певних прогалин в окремих нормативно-правових актах. Автором висловлено певні пропозиції щодо їх усунення. Зокрема, запропоновано узгодити положення законів України «Про забезпечення участі цивільних осіб у захисті України» та «Про основи національного спротиву»; у Законі України «Про забезпечення участі цивільних осіб у захисті України» пропонується передбачити чіткі умови щодо застосування зброї; Кабінету Міністрів України рекомендовано підготувати та затвердити Положення про рух опору й механізм виплати винагороди військовослужбовцям, громадянам України винагороди за добровільно передану Збройним силам придатну для застосування бойову техніку держави-агресора; унормувати права та обов’язки осіб, залучених до конфіденційного співробітництва; передбачити додаткові повноваження щодо активної фізичної протидії агресору в Законі України «Про основи національного спротиву».
The article compares the changes to the current criminal legislation, which relate to crimes against the foundations of national security of Ukraine and the draft Criminal Code, which creates a new system of norms on liability for criminal offenses against the state. The conducted analysis of modern scientific works on the indicated issues allowed us to draw a conclusion about the scientific researching of crimes against the foundations of national security, mainly under the Criminal Code in the editorial office until February 24, 2022. Large-scale aggression by Russia forced to reconsider the content of the criminal law policy in the sphere of national security. The aim of the article is to identify the problematic issues that arise when improving criminal liability for crimes against the foundations of national security of Ukraine. It was established that the draft Criminal Code provides for Chapter 9.1 in the ninth book "Criminal Offenses against State", "Crimes against State Security". This section provides for 14 articles, which contain clarifying (Article 9.1.1) and prohibitive (Article 9.1.2–9.1.14) norms. Comparison of the relevant section 9.1. "Crimes against State Security" of the draft Criminal Code and Section 1 "Crimes against the Foundations of National Security of Ukraine" of the current Criminal Code allowed to draw the following conclusions regarding its improvement, in particular, it was proposed: to change the name of Section 1 of the Special Part of the Criminal Code to "Criminal Offenses against the National Security of Ukraine" (in the CC draft - the name of Section 9.1 "Crimes against the National Security of Ukraine"); to clarify the definition of the aggressor state in paragraph 2 of Article 9.1.1 of the CC draft; to clarify the concept of "implementation of information activities" in paragraph 4 of Art. 9.1.1 of CC draft ("creating, collecting, receiving, storing, using or disseminating information in order to provide support to the aggressor state"); in p. 2 Notes to Art. 111-1 of the CC to clarify the concept: "an event of a political nature - a congress, meeting, rally, march, demonstration, conference, round table, etc., the content of which is the discussion of domestic or foreign policy issues"; in Art. 9.1.7. of CC draft to provide punishment as a crime of the 6th degree; in Art. 9.1.10 of CC draft to specify the subject of the crime through a foreigner or stateless person; part 1 of Art. 9.1.10. should be put in the following wording: "1) received from a foreign state, foreign organization, illegal armed formation or their representative the task of collecting information that can be used to the detriment of the national security of Ukraine"; to define a citizen of Ukraine as a subject in all criminal offenses provided for by parts 1-7 of Article 111-1 of the Criminal Code; to exclude the reference to "voluntary cooperation" in parts 2, 5, 7 of Article 111-1 of the Criminal Code (part 1 of Article 9.1.8 of CC draft); in part 3 of Art. 111-1 of the Criminal Code (part 6 of Article 9.1.8 of CC draft) to exclude such a form of crime as: "actions aimed at implementing the standards of education of the aggressor state in educational institutions)".
У статті розглянуто особливості нормативного закріплення інституту бойового імунітету. Встановлено, що вперше на нормативному рівні цей правовий інститут запроваджено Законом України від 15.03.2022 № 2124-ІХ, яким бойовий імунітет передбачено як новий вид звільнення від кримінальної відповідальності (абзац 3 ст. 1 Закону України «Про оборону України»). При проведенні догматичного дослідження бойового імунітету пріоритет було віддано використанню порівняльного методу (порівняння зі ст. 2.9.11 проєкту Кримінального кодексу України (КК)). Встановлено, що умови реалізації бойового імунітету в чинному Законі України «Про оборону України» та в проєкті КК мають певні відмінності. Визначено, що в проєкті КК сформульовані такі умови реалізації бойового імунітету: 1) особливий суб’єкт; 2) зміст діяння; 3) період (обстановка) реалізації; 4) мета; 5) наслідки вчинення діяння. Проведене дослідження правової регламентації бойового імунітету засвідчило про наявність певних недоліків у визначенні його правової природи та окремих ознак. Автором висловлені певні пропозиції щодо їх усунення. Зокрема, запропоновано передбачити бойовий імунітет як нову обставину, що виключає протиправність діяння; визначити суб’єктів «бойового імунітету» як військовослужбовців, членів добровольчого формування територіальної громади, працівників правоохоронного органу (альтернативний варіант – військовослужбовці та прирівняні законом до них осіб, працівники правоохоронного органу). Висловлена пропозиція щодо уточнення змісту Положення про проходження військової служби у Збройних Силах України іноземцями та особами без громадянства, через закріплення особливостей проходження військової служби осіб без громадянства. Запропонована авторська редакція пункту 1 ч. 1 ст. 1 Закону України «Про основи національного спротиву» від 16 липня 2021 р.: «член добровольчого формування територіальної громади – громадянин України або іноземець чи особа без громадянства, який перебуває в Україні на законних підставах та на добровільній основі зарахований до проходження служби у складі добровольчого формування територіальної громади».
