The juvenile justice system as a legal efforcement to guarantee the rights of children who conflict with the law. The mechanism for the criminal justice system against children is carried out through diversion involving judicial officials. However, problems arise in enforcing the criminal justice system for children engaged in Jinayah cases. It is because the Jinayah case must obey the qanun implemented in Aceh. The punishment given to the perpetrators of Jinayah can be in the form of flogging or imprisonment. For a child, that punishment can be traumatic for the child’s mental health. Therefore, this research will examine various efforts to minimize the impact of this punishment on the psychological development of children who become perpetrators of Jinayah. The problem of this study is how a child can maintain his psychological health after becoming a perpetrator of Jinayah. This research is essential to protect children’s psychological development as perpetrators of Jinayah. The purpose of this study is to find various efforts to maintain the mental development of children as perpetrators of Jinayah. Thus, the research method used to answer these problems is qualitative with a normative approach and literature study. The normative research will analyze various legal regulations regarding criminal and Jinayah acts. Then, it will support a literature study to gain a comprehensive and depth understanding of the topic of study. The results are that children as perpetrators of Jinayah have a risk of psychological trauma, and juvenile criminal law needs to be strengthened. Strengthening this law can be in the form of harmonizing the diversion of children with the Jinayah law. The cooperation of various parties, namely, law enforcement officials, social workers, and indigenous peoples, can minimize the risk of child psychological trauma.
ABSTRAKPemerintah berupaya gencar memberantas penyalahgunaan dan peredaran narkotika di Indonesia yang kerap terjadi dan telah menerobos berbagai lapisan masyarakat. Di institusi TNI, tidak jarang ditemui oknum prajurit TNI terlibat dalam penyalahgunaan narkotika, terlihat dari banyaknya perkara pidana narkotika yang disidangkan di pengadilan militer di beberapa wilayah Indonesia. Sampai saat ini belum ada regulasi khusus dari internal TNI yang mengatur Oditur Militer dalam mengeksekusi terdakwa sesuai perintah putusan untuk melaksanakan rehabilitasi medis dan sosial di rumah sakit yang ditunjuk. Lebih lanjut, belum ditemukan peraturan yang menunjuk rumah sakit milik pemerintah ataupun rumah sakit milik kedinasan di institusi TNI sebagai tempat rehabilitasi medis dan sosial yang dikhususkan bagi Prajurit TNI aktif. Tujuan penelitian ini untuk mengidentifikasi upaya yang bisa dilakukan agar perintah putusan pengadilan untuk melakukan rehabilitasi medis dan sosial dapat terlaksana di lingkungan institusi TNI dan sesuai dengan amanat undang-undang. Penelitian ini menggunakan metode hukum normatif dengan didasarkan pada pengkajian hukum positif. Penelitian ini menggunakan bahan hukum primer berupa undang-undang dan putusan pengadilan, bahan hukum sekunder berupa buku-buku, jurnal, tesis dan lain sebagainya. Pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach) digunakan dalam penelitian ini. Beberapa putusan tingkat kasasi dalam amar putusannya memerintahkan terdakwa (prajurit TNI yang didakwa) untuk melaksanakan rehabilitasi medis dan sosial, hal ini merupakan langkah progresif atau terobosan baru di ranah peradilan militer. Namun demikian, ditemui kendala dalam pelaksanaan eksekusinya. Oleh sebab itu, perlu dibuat regulasi khusus di internal institusi TNI untuk menetapkan rehabilitasi medis dan sosial terhadap prajurit yang terlibat penyalahgunaan/pecandu narkotika. Inisiasi kerja sama institusi TNI dengan beberapa rumah sakit pemerintah dan/atau seluruh rumah sakit milik TNI yang dilengkapi dengan unit rehabilitasi medis dan sosial juga perlu dilakukan.Kata kunci: prajurit TNI, putusan, rehabilitasi medis dan sosial
Bantuan Hukum merupakan bantuan yang diberikan oleh seorang ahli di bidang hukum atau penasihat hukum kepada seorang yang terkena masalah hukum di setiap tahapan pemeriksaan baik di luar maupun di dalam pengadilan. Peranan bantuan hukum bagi Prajurit TNI sangat diperlukan dalam menghadapi permasalahan hukum yang dihadapinya. Peraturan perundang-undangan yang mengatur bantuan hukum di lingkungan TNI sepanjang sejarah berdirinya TNI telah mengutamakan bantuan hukum yang berasal dari internal TNI berdasarkan perintah di mana personilnya belum memiliki akreditasi/sertifikasi, sehingga kalangan eksternal sulit memasuki lingkungan hukum militer sebab harus memperoleh izin Perwira Penyerah Perkara (Papera). Perlunya prioritas percepatan RUU tentang Peradilan Militer yang salah satunya merevisi aturan pemberian bantuan hukum kepada Prajurit TNI. Selanjutnya diperlukan kebebasan memilih dan menetapkan layanan bantuan hukum dari advokat profesional atau dengan menggunakan sarana posbakum, khususnya perkara yang diancam pidana mati dan pidana tambahan berupa pemecatan dari dinas militer. Legal assistance is an assistance given by an expertise in law area or legal advisors to those who have legal problems at every stage of investigation both outside and inside the court. The role of legal assistance for Indonesian National Armed Forces personnel is important. The Legislation covering legal assistance in the Indonesian National Armed Forces community throughout the history has prioritized internal legal assistance where the personnel itself does not have certification/ accreditation for it. The external is hard to get involve and have to obtain special permission from the Officers hand the case (Papera). Accelerating the Bill on Military Justice to revise the rules on providing legal assistance to Army personnel is priority. Furthermore, the necessary freedom to choose and establish legal assistance services of a professional advocate or by means POSBAKUM, especially cases which threatened the death penalty and additional penalty in the form of dismissal from military service.
The principle of horizontal separation is a principle in the land law governed by customary law, regulated in Article 5 and Article 44 paragraph (1) of the Basic Agrarian Law. Based on this principle, the land is separated from all objects attached to it, such as buildings and trees. The problems discussed in this paper are first, how the existence of the principle of horizontal separation in the legal system in Indonesia. Second, how the government provides the concept of legal protection for buyers in good faith towards land objects in collateral. The results of the study note that the existence of the principle of horizontal separation in the legal system in Indonesia is not fully understood by the Indonesian people, especially rural communities.
