Discoursing between law and morality is an interesting conversation among a legal scholars and jurists. Observing of legal developments are reviewed historically, the morality of jurisprudence from time to time undergoes sharp reductions. In the early stages of modern human civilization, the morality of jurisprudence still stands firmly on the foundation of the religion (christian). Moral judgments about good or bad, right or wrong, are consistently restored to the divine rules. Faced with the power of the church and the kings, came the antithesis of contradictory extreme thought, the idea that denied the existence of God or rejected the hegemony of religion and the church. The opposing of two rivals in concepts, theories and practices are concerning of the moral role of life. In turn, it had a significant influence on the development of jurisprudence in Europe at the time, leading to the spread of colonization in the eastern hemisphere.
This article is the result of research on the dynamics of direct election conflict resolution institutions in Indonesia from 2005 to 2020. This study examines regulations on Regional Head Election and law enforcement with a focus on the authority of the judiciary in resolving disputes over the results in Indonesia. The purpose of this research is to find the ideal model for a special Regional Head Election judiciary body in Indonesia. The method used in this research is a type of normative juridical research using legal materials, data, and several approaches commonly used in legal research, namely the statute approach, conceptual approach, case approach, and the historical comparative approach. The technique of collecting legal materials as data used in this study is library research using content analysis. Legal materials as data are then subjected to discussion, data analysis, and classification into certain groups to be analyzed into information. The results of this study conclude that the efforts to organize court institutions for dispute over the results of the Regional Election in Indonesia for the 2005-2020 period are very dynamic. As a conclusion and suggestions, the author proposes two institutional options for the settlement of Regional Head Election disputes which are (a) Establishing a Special Judiciary Body within the Civil Court of Justice which is domiciled in each provincial capital to adjudicate and decide on election disputes, with other expanded powers in the form of adjudicating Regional Head Election crimes as well as examining and adjudicating election, regional election, administrative process, and election disputes; or (b) Defining the authority of the Constitutional Court to adjudicate disputes over the results of the Regional Head Election (in addition to the PHPU) without any differentiation between the General Election and the Regional Head Election. This article is a legal research which conducts a comparative study of the dispute resolution institutions between the Indonesian and Brazilian elections. The purpose of writing this article is to map the similarities and differences in the practice of dispute resolution between regional head elections in Indonesia and Brazil to take good aspects that are suitable for implementation in Indonesia. In the discussion, it also covers the practice of organizing elections, election management organs and institutions, including the practice of dispute resolution for Election / Pilkada in both countries. The research method used is normative legal research using primary legal materials in the form of statutory regulations and court decisions, using a comparative approach, a statutory approach and a conceptual approach. Conclusions from the discussion of the research results, the authors propose two institutional options for Pilkada dispute resolution in Indonesia: a) Establishing a special election / election court under the PTUN environment. This Special Judiciary is domiciled in each provincial capital to adjudicate and decide on election result disputes (Election / Pilkada Crime and also examine and adjudicate election / election / election process / administration disputes), or b) Define the authority of the Constitutional Court of Justice to adjudicate disputes over the results of the Pilkada (in addition to PHPU) without any differentiation of regime.
Artikel ini merupakan hasil penelitian hukum dengan kajian kiprah dan usaha Muhammadiyah mewujudkan negara hukum indonesia sebagai negeri baldatun thoyibatun warobbun ghofur. Tujuan dari artikel ini diharapkan tumbuh diskusi lebih serius dan upaya implementatif mewujudkan negara hukum Indonesia yang sejahtera, adil dan makmur, sebagaimana konsep negeri baldatun thoyibatun warobbun ghofur yang menjadi semangat pengabdian Muhammadiyah. Metode yang digunakan dalam penelitian artikel ini adalah penelitian hukum normatif menggunakan beberapa pendekatan yang biasa digunakan dalam penelitian hukum, yaitu pendekatan perundang-undangan, pendekatan konsep, pendekatan sejarah, dan pendekatan perbandingan. Simpulan artikel ini menyajikan bahwa dalam sejarah perjalanan bangsa Indonesia, Gerakan Muhammadiyah telah mendampingi Negara Hukum Republik Indonesia, sejak dari meraih kemerdekaan, mempersiapkan kemerdekaan, mengisi kemerdekaan, hingga saat ini menjaga dan merawat bangsa yang besar ini agar tetap bersatu dan berdaulat. Namun mesti disadari bahwa hingga saat ini, bangsa Indonesia masih berkutat menjalankan negara hukum formal. Sebagai negara hukum, bangsa ini lebih sibuk dengan prosedur formalitas, menegakkan hukum namun justeru abai pada esensi tujuannya untuk kemanusiaan dan kesejahteraan. Untuk itu bangsa ini perlu lebih fokus pada cita-cita kemerdekaan dan tujuan bangsa mewujudkan kesejahteraan umum dan keadilan sosial bagi seluruh rakyat Indonesia dalam semangat mewujudkan baldatun thoyyibatun wa rabbhun ghaffur.
Tulisan ini bertujuan untuk meninjau dan menganalisis pelaksanaan tugas Polri guna mendukung penerapan protokol kesehatan selama pandemi Covid-19 dalam rangka terwujudya situasi kamtibmas yang kondusif. Metode yang digunakan dalam penelitian dan penulisan ini adalah metode penelitian hukum normatif, dengan beberapa pendekatan yang biasa digunakan dalam penelitian hukum, antara lain; pendekatan perundang-undangan, pendekatan konsep, pendekatan kasus, pendekatan analisis, dan pendekatan historis. Hasil temuan menunjukkan bahwa sesuai fungsinya, Polri telah melaksanakan tugas guna mendukung penerapan protokol kesehatan selama pandemi Covid-19 dalam rangka terwujudya situasi kamtibmas yang kondusif. Hal tersebut dilaksanakan dengan cara antara lain: Pertama, preventif: menerbitkan STR untuk panduan anggota melaksanakan Tindakan-tindakan pada masa pandemi dan masa transisi Normal Baru, Binmas, Sabhara, Lalu Lintas dan satker-satker lainnya terlibat aktif memberikan informasi dan penyadaran pada masyarakat. Bersama-sama dengan Pemerintah Daerah menjaga keamanan dan ketertiban masyarakat dengan memanfaatkan teknologi, misalnya dengan CCTV, drone, aplikasi-aplikasi online. Merangkul masyarakat dengan humanis, sehingga masyarakat yang terdampak Covid-19 secara kesehatan maupun secara ekonomi dapat survive. Kedua: preemtif: melakukan patrol-patroli dan razia-razia untuk mencegah kejahatan. Ketiga: penegakan hukum sebagai upaya terakhir bagi orang-orang yang melakukan perlawanan meski melanggar, termasuk memerintahkan pengendara motor dan mobil untuk putar balik karena larangan mudik Lebaran.
