The article deals with peculiarities of behavior of subjects of financial relations. Specific features of legal behavior are analyzed. It also studies the signs of lawful and unlawful behavior. Abuse of law are considered within misconduct. It is marked that public financial rights are protected by law, except when their implementation is contrary to the purpose of these rights in a legal state. Thus, subjects of financial relationships, exercising their rights act within legal behavior. Their action or inaction can be both lawful and unlawful. It is summarized, that in practice, it is important causal link between the act and the effects that it has caused. With this in mind, it turns especially important and difficult for state-government agencies to prove the fact that actions or omissions of a subordinate subject of financial relationships have signs of illegibility, their behavior is illegal. And it is important to a subordinate subject to prove the legality of their actions. An arsenal of evidence is used for this purpose, as well as evidence is created.
The objective of the article is to study the positive experience of foreign countries in exercising departmental control over the activities of judges and to identify possible ways of its application in Ukraine. While writing the article the author has used general scientific and special methods of scientific cognition, namely: systematic, comparative and legal, functional and documentary analysis. Based on the analysis of scientific sources the author has studied the experience of the UK, France, Poland, Asian in exercising departmental control over the activities of judges. It has been determined that quite different approaches have been currently developed in Europe regarding the exercise of departmental control over the activities of judges, which is conditioned by the specifics of the legal systems of countries in general and the judicial system in particular. At the same time, despite the presence of certain differences, this does not exclude the possibility of applying the relevant positive foreign experience in our country. Based on the results of the conducted research, the following has been suggested, taking into account international experience in exercising departmental control over the activities of judges: a) to optimize the system of entities, which are authorized to exercise control over the activity in the specified sphere; b) to create a legislative base for exercising departmental control over the activities of judges, in particular by developing and adopting a single legal act in this area; c) to strengthen the supervision over the courts while maintaining the limits of the independence of judges; d) to expand the financial and logistical support of the entities of departmental control; e) to create organizational and legal conditions, where judges will in no way be able to influence the departmental control; f) to develop a clear and understandable system for evaluating the performance of judges.
The purpose of this article is to identify ways to improve organizational measures to ensure public security and order during the mass events by the National Police. Methods such as structural-functional, formal-logical, modeling, analysis, and synthesis were used in the writing of the article. The successful implementation of this measure depends largely on organization, relationships between each police authority and unit, rational distribution of forces and resources, early response to the detection of violations and other events, effective coordination, placement of patrol posts and routes. The Department of Organizational Analytical Support and Rapid Response, which ensures within competencies its coordination, planning, control and coordination of actions of all authorities and units involved to ensure public security and order during mass events, plays an important role in the police work in this direction. It was therefore concluded that: a) improvement of decentralization of the management system of police authorities and units, establishment of the mechanism of its coordination with the territorial police bodies; b) equipping of police authorities and units with modern communication means, GPS-navigators, gas analyzers for identifying the state of drunkenness, video cameras, devices of operational identification, computing complexes etc.; c) developing close cooperation with citizens and their associations, with local communities; d) conducting trainings on keeping public order and providing public security, psychological and physical training, analytical work and more.
