BUMDES adalah badan hukum yang didirikan oleh desa yang berguna untuk meningkatkan perekonomian di desa. Penerapan Good Corporate Governance (GCG) didalam pengisian jabatan dan pengelolaan BUMDES penerapannya akan berdampak pada desa yang mandiri dan sejahtera dikarenakan BUMDES masih belum dapat mensejahterakan masyarakat desa. Tujuan penelitian ini guna mengetahui pengaruh pengisian jabatan dan pengelolaan didalam BUMDES guna meningkatkan perekonomian di desa. Metode pendekatan yang dipakai metode yuridis normatif yaitu mengkaji penerapan kaidah atau norma dalam hukum positif. Metode analisis data menggunakan metode kualitatif yaitu melakukan wawancara secara lisan dengan informan BUMDES Kertamukti, yang selanjutnya hasil wawancara tersebut dianalisa dengan memperhatikan aspek hukum positif yang dilanjutkan dengan menarik kesimpulan secara umum untuk menjawab permasalahan yang diajukan. Pengisian jabatan di BUMDES Kertamukti sudah sesuai dengan yang diamanatkan oleh UU DESA dan UU CIPTAKER sebagaimana jika dilihat didalam PERDES, dan dikaitkan dengan GCG pada penerapannya belum sesuai. Pengelolaan BUMDES Kertamukti dalam pelaksanaannya belum berjalan dengan baik, peran dari pemerintahan supradesa penerapan fungsinya sebagai pengembangan BUMDES dan pembinaan sumber daya manusia (SDM) belum berjalan sebagaimana yang seharusnya.
This research studies: first, legal problem of Banking Guaranty Law in International Syndication Loan Collateral; second, mechanism of fixed collateral to cash collateral transmission which can be implemented in International Syndication Loan Collateral in Indonesia. Third, perspective of fixed collateral to cash collateral transformation in International Syndication Loan Collateral for the development of Civil Law in Indonesia. The method used was normative juridical using qualitative descriptive analysis method. The research findings conclude: First, the prevailing collateral law in Indonesia currently has not yet given assurance to the infrastructure project management to be trusted in channeling great amount of fund from International Loan Syndication. Second, Collateral Legal System in Indonesia is still unable to settle some problems, such as large amount of collateral value, small amount of collateral types which is not equal with the amount of loan limit, the relatively large value change of project, and loan execution involving other country's legal system. Third, regulation perspective on the transformation and transmission of fixed collateral into cash collateral can be conducted in two alternatives.
This paper tries to show how Indonesian economic law has evolved via the emergence of the cyber notary idea. Notaries engage in various everyday tasks and activities in the fantastic world development, such as giving the clients the finest service possible and impacting the economy. According to the law, notaries are required to be able to help and support anyone who requires genuine written documentation of legal situations, events, or activities. This study employs qualitative approaches and descriptive analysis. Additionally, researchers are interested in the phenomenon that examines the idea of a cyber notary as a way to advance Indonesian commercial law. Qualitative research aims to conduct extremely thorough investigations that examine the research's findings in great detail. Both primary data and secondary data are employed as sources of information. The findings demonstrate that cyber notary adds value to electronic documents by legalising them, for example, in addition to digitising notarial operations. However, because many aspects need to be ready, its implementation will take some time. Article 1868 of the Indonesian Civil Code stipulates that a genuine deed is a deed in a certain form that has been prescribed by law and is made before a public authority.
