Examining some recent examples from the Court of Justice of the European Union case law, this article intends to unravel the direction to which the European courts turn towards in times of crisis. The fiscal restraint and socioeconomic restructuring dictated by considerations of public debt reduction affect the daily lives of European citizens. However, the crisis and the austerity measures framed by Union law follow the new visibility that fundamental rights assumed in the integration process with the entry into force of the Charter of Fundamental Rights of the European Union. Therefore, in accordance to the moto proclaimed by Cunha Rodrigues, the crisis highlights the role of jurists and, in particular, the judges while guardians of democracy – understood as the safe exercise of fundamental rights. This paper therefore considers the transformative potential of the current crisis and its implications on the deepening of citizenship rights in the European Union.
A boa administração nas 'calhas de roda' dos discursos jurídico-constitucionais português e da União -'Gira, a entreter a razão'…? A escolha do tema da boa administração para um debate que pretende assinalar os 40 anos da Constituição da República Portuguesa (CRP), incluindo as três últimas décadas da sua interação com o projeto europeu -que também é um projeto constitucional -encontra a sua primeira razão de ser na intrincada, e pontualmente inextrincável, relação entre Direito Constitucional e Direito Administrativo.
Desde a consagração do "direito a uma boa administração" na Carta dos Direitos Fundamentais da União Europeia (CDFUE) que o interesse pela temática da boa administração na ordem jurídica da União Europeia tem recebido alento renovado. Isto, pese embora as dificuldades trazidas à luz do dia pelos contornos específicos da disposição normativa em causa-o artigo 41º CDFUE. Na jurisprudência do Tribunal de Justiça, o debate conheceu discreto, mas, porventura, terminante desenvolvimento no acórdão Ispas. Através de uma leitura conjunta do acórdão com as Conclusões apresentadas pelo Advogado-Geral Michal Bobek no quadro do mesmo processo, o presente texto procura contextualizar o caso Ispas à luz do enquadramento do exercício da função administrativa da União pelas autoridades administrativas dos Estados-Membros e, em particular, da problemática resultante da não inclusão dos Estados-Membros no âmbito de aplicação do artigo 41º CDFUE relativo ao "direito a uma boa administração".
RESUMO: Em setembro de 2015, o Tribunal de Justiça da UniãoEuropeia detalhou, no acórdão Taricco, o alcance das obrigações dos Estados-Membros no combate à fraude fiscal lesiva dos interesses financeiros da União. Aquele Tribunal voltará brevemente a pronunciar-se sobre a interpretação firmada no referido acórdão, pois a compatibilidade da solução aí fixada foi questionada à luz de um princípio supremo da ordem jurídico-constitucional de um EstadoMembro -no caso, o princípio da legalidade dos delitos e das penas, cuja desconsideração seria suscetível de vulnerar a identidade constitucional da República Italiana. Neste contexto, importa aferir: i) o que integra a identidade constitucional dos Estados-Membros, ii) quem tem competência para a definir, ii) qual o alcance dessa definição para o direito da União Europeia. É o que as Autoras pretendem desvendar neste texto, a partir de um caso de estudo pendente no Tribunal de Justiça -qual seja, o caso M.A.S. e M.B. -no âmbito do qual o referido Tribunal foi chamado a esclarecer as implicações jurídico-constitucionais do caso Taricco.
