Notaries as public officials have the function to create perfect evidence, act carefully and do their work in all honesty to maintain the dignity of a notary. In the making of an authentic deed, witnesses who participate in the making of the authentic deed are required. Witnesses and its qualification, or conditions that must be met by the witnesses have been determined by the law that can be found in Article 40 of Law Number 2 of 2014. The issue raised in this case is the Supreme Court Decision Case Number 156 K/PDT/2020. In this case, there are two deeds of sale and purchase which have the siblings of the seller stated as the witnesses . Therefore, this study will discuss what legal consequences arise from these actions and the responsibility of the notary as the party who made the deed of sale and purchase of the land. Dalam pembuatan akta otentik, diperlukan saksi-saksi yang ikut serta dalam pembuatan akta otentik tersebut. Saksi sendiri diatur dalam Pasal 40 Undang-undang Nomor 2 Tahun 2014 Tentang Jabatan Notaris, adapun syarat yang harus dipenuhi oleh saksi telah ditentukan oleh Undang-undang. Permasalahan yang diangkat dalam kasus ini adalah mengenai Kasus Putusan Mahkamah Agung Nomor 156 K/PDT/2020. Pada kasus ini, dua orang kakak beradik menjadi saksi pada akta jual beli tanah yang dibuat oleh satu sama lain. Oleh karena itu, Penelitian ini akan membahas akibat hukum apa yang timbul dari tindakan tersebut serta pertanggungjawaban notaris selaku pihak yang membuat akta jual beli tanah tersebut. One of the powers of a Notary is to be able to make a will as mandated in the UUJN, including making a will before witnesses as regulated in Article 939 paragraph (4) of the Civil Code and making a will without witnesses as regulated in Article 939 paragraph (2) of the Civil Code. A Notary in carrying out a legal action must always act carefully so that the Notary before making a deed must examine all relevant facts in his consideration based on the applicable laws and regulations. The making of a will by a Notary must pay attention to all the provisions regulated or determined in the provisions of the legislation governing the implementation of a will. So that in the future nothing happens that can harm the parties which can then also harm the Notary who made the will. This study focuses on discussing legal protection for will recipients against notaries who do not report a will. This study uses a normative juridical method with a statutory approach and an analytical approach. Legal protection for the beneficiary against a Notary who does not report the list of deeds, namely preventive legal protection and repressive legal protection. If in the making of the will, the requirements and elements have been determined as stipulated in the Civil Code and the Law on Notary Positions, then legal protection for the beneficiary will still exist and reporting is an administrative requirement that must be met.
Notaries need the help of others to carry out their duties and authorities in making authentic deeds. Other people who work help the Notary, do work in the Notary's office, as a worker. Workers become Notary employees or not become Notary employees, which is only limited to doing the work given by Notaries. In connection with the implementation of the position of a Notary Public there is a possibility that an unlawful act will occur by a person who does work at the Notary Office. When an act of unlawfulness occurs at the Notary's Office, the Notary will be held accountable, because the public who require the services of the Notary understands that for making an authentic deed is in the Notary's Office. In the event of an act against the law, the public does not distinguish whether the act against the law was committed by a Notary Public employee or not. What is certain is that unlawful acts occur in the Notary's office and are related to the implementation of the position of Notary in the context of making an authentic deed. Based on this, this paper tries to explain and analyze the responsibilities of a Notary in the event of an illegal act in the Notary's Office.
ABSTRAK Tujuan studi ini ialah untuk mengkaji urgensi peran Notaris dalam pembuatan akta Perseroan Pemegang Saham Tunggal, pertanggungjawaban hukum Perseroan Pemegang Saham Tunggal dan peran legalitas pemegang saham tunggal sebagai upaya percepatan pembangunan ekonomi nasional. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil studi menunjukkan bahwa akta Notaris dalam pendirian akta Perseroan Pemegang Saham tidak diharuskan menurut Undang-Undang Cipta Kerja namun jika digunakan dapat memperkuat legalitas Perseroan Pemegang Saham Tunggal. Status hukum Perseroan Pemegang Saham Tunggal yaitu bertanggungjawab secara terbatas sesuai dengan ketentuan Undang-Undang Perseroan Terbatas. Dalam perspektif pembangunan ekonomi nasional, perseroan terbatas memiliki peran sebagai stimulus pengusaha dalam memulai bisnis. This study uses a normative legal research method with statutory and conceptual approach. The results of the study show that a Notary deed in the establishment of a single member company is not required according to Job Creation Law. But can be used to reinforce the legality of a single member company. A single member company has the status of a legal entity and shareholders have limited liability in accordance with limited liability company in general. In the perspective of national economic development, limited liability companies plays an important role as a stimulus for entrepreneurs in starting a business to form the ease of doing business. AbstrakDi Negara Jepang, populasi usia tua tidak diimbangi dengan tingginya jumlah usia produktif, hal ini menyebabkan penurunan tenaga kerja secara tajam. Oleh sebab itu pemerintah Jepang berupaya menerima perawat asing ke dalam sektor perawatan jangka panjang dengan menandatangani perjanjian kerja sama ekonomi bilateral dengan Indonesia yang disebut sebagai Indonesian Japan Economic Partnership Agreement (IJEPA) pada tahun 2007. Walaupun sudah terikat dengan kontrak kerja yang berada pada pengawasan IJEPA, pastinya pekerja migran yaitu perawat pernah dalam situasi rentan dan diskriminatif di luar kontrak kerja. Penelitian ini mengamati peranan Badan Perlindungan Pekerja Migran Indonesia yang bekerja sama dengan IJEPA dalam skema penempatan dan perlindungan hukum pekerja migran Indonesia khususnya perawat dan juga membahas pemenuhan hak-hak pekerja migran Indonesia di Jepang dengan menggunakan indikator ekonomi. Therefore, the Japanese government is trying to accept foreign nurses into the long-term care sector by signing a bilateral economic cooperation agreement with Indonesia called the Indonesian Japan Economic Partnership Agreement (IJEPA) in 2007. Even though they are already bound by a work contract that is under the supervision of IJEPA Of course, migrant workers, namely nurses, have been in vulnerable and discriminatory situations outside of their work contracts.This study examines the role of the Indonesian Migrant Worker Protection Agency in collaboration with IJEPA in the scheme for the placement and legal protection of Indonesian migrant workers, especially nurses and also discusses the fulfillment of the rights of Indonesian migrant workers in Japan using economic indicators.
