Los puntos de vista pertenecen a los autores y no reflejan necesariamente los de las instituciones participantes.Resumen: Este capítulo examina el impacto jurídico del tratamiento del narcotráfico como conducta conexa al delito político en el marco de la etapa de posacuerdo en Colombia, caracterizando el alcance normativo y la obtención de prerrogativas penales como las amnistías o los indultos. Se establecen por medio de un método de investigación cualitativo guiado por una revisión documental y jurisprudencial las particularidades del tipo penal, junto con las diversas perspectivas que examinan las consecuencias producidas por la renuncia del ius puniendi sobre el tráfico de drogas. Como conclusión, se determina que la figura de conexidad empleada en el sistema jurídico colombiano permitiría que este tipo penal pluriofensivo que constituye una amenaza transnacional a la seguridad y defensa sea amnistiable en virtud de la aplicación de criterios como el margen nacional de apreciación, encontrando conexión primaria por ser la principal fuente de financiación del conflicto armado en Colombia.
